Help with name(s) on membership vs resale

I think I've gotten myself into a bit of a tangle with regards to names in play across memberships and could do with some help/advice on how to approach...

I'm a direct owner and have just put in an offer on a resale contract that has been accepted and now it's time to sort contracts and stuff.

My problem is with the names in play.

On my direct contract with Disney under profile > membership information I have:
My old name (purchaser)
My ex-partners name (additional purchaser)

My new resale contract will be:
My new name
(no ex partner)

I'm reaching out to member services today to see if they can at least update my name to be my new name so they match, but I read there can be issues with one contract having two people on it and the other having just one? I'm in the final steps of divorce and have a court order to get my ex-partners name taken off the direct contract and am just awaiting the final divorce decree to come through before I send all that off to a title company to get the ex off of there.

Am I going to be able to get both of these under the same membership in their current forms? If it has to go through as separate memberships in it's current state is there a way to rectify (merge?) the two after the ex is off of the direct contract?

I really don't want to be logging in and out to make bookings across the two contracts! Am I screwed here?
 
I think if your resale closes before your divorce is finalized, then it creates 2 memberships.

If your current membership is in its current form when DVC receives the title for the resale contract, then they will establish a second membership. Your first membership would need to be re-titled and DVC in receipt of that before they receive the title for the resale.

Can you delay purchasing resale until you have finalized the name change on the current membership?

DVC can easily update your name once they have that paperwork.

Agh, I thought that would be the case!! So the issue lies more with two names on direct contract and one on the resale vs my name being different.

I might reach out to the title company and see if they'll proceed with just the court order that states I am to take full sole ownership of the contract.

Hopefully DVC are quick to turn these things around and I can be a bit cheeky and drag things out on the resale side until it's gone through.
 
If this can't get sorted before DVC receive the title for the resale what would that look like?

If it's two memberships then presumably I wouldn't be able to pull points from both for one booking? They'd be different log-ins?
 

I would leverage help from your title company. Once DVC gets the correct paperwork from your divorce, they move pretty quickly to update names on memberships. Good luck with everything!
 
It will be the same long on (email and password). You will see two memberships. You can’t combine from both; they work independently. You get one transfer per year.

It’s not about how you purchase the resale contract.

A membership must have the same owners and UY.

Until DVc gets a new deed for your current contract that no longer has your ex partners name on it, they can’t legally put your new contract in that membership.

Having a court order won’t change that. The deed has to be changed.

Now, if the process of removing your ex partner’s name from the deed doesn’t happen until after your resale membership is created, then you can always ask MA at that time if they can combine the memberships since owners of both now match.

I have no idea if that can happen. If you already know you will take ownership of the direct contract, I’d start the process to update title.

The only part is financing. No idea how that would work if you have a loan with DVC.

Yeah that's what I figured. I may not have been clear in conveying my understand in the post you quoted.

I'm already talking to LT transfers about changing the existing contract so the ball is rolling.

Re: financing - yeah I checked and Disney won't allow a deed/membership change while there is an outstanding loan, so that's a fun additional cost I now need to clear down. So fun.

I think this would be possible.

It would be even easier if you delayed the resale close long enough that MA will have changed the names on your current membership. LTT can probably tell you how much time they'll need; we've been happy with their work in our divorce. You may have to offer the sellers a little something extra, but it might be worth it to simplify things.

Then if you have the ball rolling that’s a good thing.

It’s good you have started!! What I would do then, once this resale contract passes ROFR and you have signed the number papers, is send an email to MA alerting them if the situation.

Ask them to hold off creating the new membership until you have the new deed. Have the title company send a note once this closes with the same request.

It may delay your use of it a bit, but it will prevent the headaches later!

Most people want MA to speed up the process. It would seem it will be much easier to ask them to wait until your current membership is titled correctly!!

Very smart idea!!

The resale contract is stripped and I don't intend to visit for a year or so anyway so this could very well be the play!!

My biggest concern was causing the seller hassle by dragging my feet but getting member administration to hold off on their side following ROFR is a much better idea!! Thank you so much!
 
Related question I didn't even know to ask until reading this thread: if I'm buying a resale contract, but down the line intend to go direct and have blue card benefits and want my family on that contract to give them blue card access (eg if my parents want to go take a break in the lounge without me, I'd want them to have that access), do i need them on this contract too?

Your parents do not need to be on your current resale as the 150 point contract minimum for Membership Extras is enough to stand alone as its own membership.

Because the resale and direct would be titled differently, they would be 2 different memberships and you would be unable to use them together without transferring as a PP has said.

As long as the listed owners on the deeds match (meaning you cannot have additional persons on one contract) then they are one single membership.

edited to add: You were asking in regards to gaining Membership Extras. If you wanted to purchase a direct contract for MExtras and intend to add your parents to the deed, I would suggest adding them to your resale first unless you wanted the added hassle of having two memberships. Then yes, you would need to transfer if wanting to combine points but you'd be possibly limited by the 1 transfer limit per year.

Simple answer:
Yes, you would have to re-title your resale deed(s) to add your parents. Then when you purchase the direct and have all the names match, then the direct easily gets added to your membership the same day.

Complicated answer:
Technically, no. Because the minimum for Membership Extras is 150 points, you could theoretically just purchase a whole new membership without taking action on your existing resale. As mentioned earlier, this would result in two separate memberships that would require transfers and it definitely not as easy to use together.

The main thing is re-titling your resale. You can elect to do this first or after if the end goal is to ensure all contracts are in the same membership for ease of use.

Ok this is good to know! I'm in the "looking for a contract I like" part of my first DVC purchase and I wasn't planning to get my family involved until I was ready to commit to a larger direct purchase, but it might be worth just adding them from the start. Is retitling hard/complicated? Thanks for helping this newbie!

It's not easy, but not hard per say. I've never done it. There are companies often mentioned on these boards like LT Transfers that you can pay to assist with the process, or there are threads on these boards on how to do it yourself.

Also: a reminder that purchasing DVC is a real estate transaction and can have tax implications for all parties named on the deed. This is often brought up for those looking to add adult (18+) children but applying for financial aid.
