Help! What does He need to move out?

My son's friend is 18 years old. He has Type 1 Diabeties. His bio Father emancapated (sp) him back in August. Mom and Step Dad just kicked him out a few days ago and he has been living with us. *some of you read the story* Here is a link if you want details.. http://www.disboards.com/showthread.php?t=2021432

Anyway.....

I'm assuming he needs to either get a Court Order or a Police Escort or something to get his posessions out of their home..

I started a list but I don't want to forget anything..

Can you help?

This is what I came up with:

Birth Certificate
HS Diploma
Vocational School Diploma
Social Security Card
Medical Records
Medical Supplies
Clothes
Car Insurnace Policy records

His bank account is under his and his mom's name but he does have his Bank Book, although, Mom drained most of it already

He has his Driver's License on him

Title for his truck, he says is in His and Step Father's name, not sure what to do about that.. The car Insurnace is ONLY in his name..

I'm probably forgetting a hundred things.. :headache:

I assume he will have to go to Social Services to get Medical Assistance for his Diabeties
 
Hmmm...any tax records, like former tax returns and the like is the only other thing I can think of.

I know it was mentioned in the other thread, but he needs to put a fraud alert on his credit reports, it will help prevent his mom and step dad from opening accounts in his name. He should also check his credit reports to make sure they haven't already done so.

I think he should speak to legal aid about the issue with the truck, he needs to find out his rights in regards to that.
 
Remember, he can get a new birth certificate by contacting vital records in the county of his birth. He can also get a new social security card (new copy, not a new number), though he might want that birth certificate first.

That said, I wouldn't want to leave those things in that house! Who knows what his "parents" might do!

No one has EVER asked me for a copy of any diploma. If anything they would want the official, notarized transcript from his schools, which he can get from the schools. The diplomas however, not that important.

Medical records can be had from his health care providers, and it's probably a good time to go to his doctors and make sure he takes his parents OFF the list of people who can look at them, if they have been on it during the time he was a minor.

Check out his local DMV to see what he needs to do to get his stepdad off the title.


And yes, other than that, clothes and insulin etc.

Most of those documents are replaceable. And might cost less to replace then going forward with a police escort or court proceeding.

I would just start over and request all the documents from the city. If he is still living in the city he was born it will be VERY easy. If not, than it will take a few stamps and a trip to the copy machine. As long as he still has his license. The insurance company will fax him copies for his insurance.

How do you prove who you to obtain a Copy of your Birth Certificate, plus wouldn't a copy be no real good, he would need the Original with the raised seal to do most things that require a birth certificate.. :confused3

He has his valid drivers license, here, on him so that is a Plus

He has his valid drivers license, here, on him so that is a Plus

I'm not sure what you need to get a copy of a birth cert, but I do know that a copy from the county is treated exactly the same as the original one you get when you're born (actually, that's a copy too as the real original stays with the county). My father had to replace his in order to get a passport a few years ago. It had the raised seal and everything, and works just fine.

you can get a legal copy.. Its a copy with the raised seal on it. It is perfectly legal..(I took it to get a new ss card for myself) I had to pay $10 for it...
 
Go to your state's website and search for birth certificate. It will give you all the info you need. I think in some states this is a county function, so you may need to check the county's website. You will get a certified copy. I had to do this a few years ago for my passport.
 
Did his step-father pay for the truck or is he simply the co-signer for the loan?

If the son has any canceled checks or bank statements that prove he was the one actually making the payments I would think those might turn out to be important.

I think what you're doing for this boy is just amazing. He's really blessed to have your family there for him. This situation could be so much worse without your family.
 
I would maybe suggest that he takes all his old pay slips out of the house too. Im not sure what information is on your US pay slips, but here they have your National Insurance number on them, and some will have bank details on them.

What's the situation with his medical care/insurance?

That is probably going to be the most important thing to deal with, esp. with his diabetes. I think he could probably get medicare/medicaid (I can't remember which one it is), or if not, often there is a county-funded health plan he could get signed up for. Hold on to his documentation stuff because it will be needed to get him health coverage. Find out where the nearest county (free) health care facility is now in case he needs any treatment before the medical insurance stuff goes through. I don't know whether he needs regular medical contact for his insulin pump and other diabetes-related stuff -- ask him how often/what kind of medical care he usually gets.

Need to close the one bank account and start a new one in his name , only.
If the account is listed as "His Name or His Mother's Name"-he can do so without her signature. If it listed as "His Name" and "His Mother's Name"-he must have her signature. Depending upon the amount of money in the account, if Mommy has to sign off...I might just walk away from it if I were him. $20 isn't worth it, KWIM?

The Truck-if it has a lien on it...it will have to be paid off before the name can be taken off of the title (either by selling it or just paying it off).
The lien is a contract between the bank and the boy & the bank and the stepdad. The bank isn't going to let either name be taken off until they get their money or they get the truck. If their is no lien against it, the StepFather will need to sign the title over to the boy & the boy needs to have it done in the presence of a notary republic.(the sealer) Once again, the boy needs to decide what he wants to do with the truck? I'd say StepFather, more than likely, is not going to sign it over (it is something to hang over the boys head...a way to control). I would talk to someone in law, if I was you...the boy can't sell the truck without StepFather's sign., either. Nothing is stopping StepFather from just coming & getting the truck-on paper, he is partial owner. If StepFather then wrecked the truck...the boy could be held responsible to any damage done to it or other's property since he is the one holding the insurance. Is it worth the possible consequences?

If haven't taken pictures of the bruises/scratches & they are still there...need to take those. Preferable to use a camara that will embed the time/date on the picture. That can help him get an EPO (Emergency Protection Order) against the Step-Dad. Step-Dad won't be able to get within so many feet for a set amount of time. (Unfortuntly, this includes if the boy tries to get the title signed.) With the EPO, he can ask for a Police Escort (at his cost) into their home. It will insure that the StepFather isn't there.

High School Diploma/Vocational School Certificate-will need for some jobs in his future. Need to make copies of each. Needs to put them in a lockable, fire proof, water proof, safe box. Last time I checked, Target & Wal-Mart both carried them for around $50-60.

His current doctor needs to be made aware of the situation immediately. The doctor can help establish a future care plan, and have ideas on the medicine financial side.

The rest of the list looks good. Only other things would be personal stuff (sentimental-pictures,etc., vocational books that he may need for reference, later in life).

The truck is not new, it's older so no payments to worry about and no loan

Yep.

What a parent originally gets is simply an official (certified, which is a notary who works there for the gov't b.c. office) copy of what they have on record. The one the parent originally got is exactly like the one you get 50 years later, legally, even if their forms have changed in the meantime.

If you're in or near the county of his birth, he can just go to the Vital Records/Statistics office, sometimes called the Registrar's Office, and they will tell him what he needs. It'll cost about $18 for it. At least that's the cost for hubby and son's WA b.certs as well as my CA b.c.. You can look up the info online, too, so a trip isn't wasted if you don't have what they need.

I did call social services for our county and of course had to leave a message on voicemail and got no answers what so ever..

He needs to fill his pump every other day with insulin and change the sticky pad things.. He also has a tester kit with strips he uses 8 - 10 times a day..
 
Very important!
Have him fill out a Health Care Proxy and name you ( or another responsible adult of his choosing) to make medical decisions for him should he become unable to do so.
This is very important especially since he is diabetic, and should he go into diabetic coma or insulin shock, he will need someone to sign consent forms and talk to the doctors and visit him in the hospital etc.
If he doesn't have a Health Care Proxy filled out, things could get pretty messy should his family try to get involved.
You can get a HCP form at his doctor's office or at the local hospital.
Power of Attorney would be a good thing to have as well.
