Looking to speak with anyone who was booked with Air Transat

Sat. April 3/2010 Toronto to Orlando
Flight TS882 orginally operated under skyservice but then changed to CanJet
PLEASE NOTE - this flight was booked for April 3 but when Air Transat changed to Canjet the flight got changed to April 4

Iam in the process of sueing Air Transat. Long long long story short - when my flight was changed to Canjet the date was changed to April 4. I never received any notification on this (AirT says an email went out, but I never received it). Once I found out AirT RESENT me a new ticket with CanJet's name on it - BUT THE DATE WAS STILL LISTED as April 3.

We showed up at the airport on April 3 only to be told "im sorry that flight doesn't leave until tomorrow" Stranded with 2 small children. We had to pay an extra $1500 (on top of our round trip tickets) just to get out of the airport that day. Now AirT will not reimburse me this money.

Please let me know if you have a similar situation. My court date is in Sept. 2010 Thank you for time.
 
No I'm sorry I wasn't on that flight.

I'm surprised they haven't already settled with you, it will probably cost them more to defend themselves, unless you're sueing for more than your actual costs of $1500. Not to mention the bad customer relations and publicity.

I hope you get your full recovery.
 
Is your suit in small claims court? If so, you'll probably win by default. Large companies usually don't bother sending lawyers or reps - costs more than losing the trial.
 
Just to point out that the OP will be suing in Canadian court. Not sure how different that is from a US court, but thought I'd mention it.

At least, I assume it is in a Canadian court since AT is a Canadian charter airline.

Not totally understanding the story (how did the OP find out about the change if AT never contacted the OP and why would they only find out about half the change?), but I hope things work out.
 

Be careful what you post on a public message board, especially when mentioning a potential lawsuit, as it may affect the outcome of the case.

In short, stop posting here about that and seek legal counsel in your jurisdiction.

Im just saying for others who may be in the same boat - dont let these big airlines (no matter who they are) walk all over you. Most of them have something on their websites called "service and commitments to passengers" Im sure if you read them carefully, you'll note airlines are not following their own commitments.

I think "little" people are scared to take on these big companies (airlines or not). You have nothing to lose if you dont try.

Since OP has a court date, I would assume she/he also has legal counsel.
If they haven't advised the OP to not post on a public message board about the case, I'd question their competency.

I'm not scared to take on a company. I am scared of jeopardizing my case :)

The OP is suing for well more than their costs. They are suing for $10,00 according to posts on other boards.
 
I would think that suing for well more than the added costs would be unreasonable but adding on some for inconvenience, and other expenses such as a hotel room, would be reasonable.

Was there a flight leaving on the third?
 
Small claims court in Canada, isn't at all like sueing in the states. Here we say we are taking them to small claims court. The max amount you can claim use to be $10000, It just changed recently so if I had to guess that is where the number came from.

Good luck to the OP and I will remember never to try and Fly Air transat (I did in the past and really hate their planes anyway).
 
As mentioned above - I took Air Transat to small claims court over an incident I had with them, and an error they made. They didnt want to be accountable for their error so I took them to court.....and I won!

I was asking for a crazy amount in my claim, in which I wasnt expecting to get, but I was trying to prove a point. I did receive all my out of pocket expense back and then some. Most importantly they've lots all my future business as well as my family and friends business. Sometimes word of mouth is the best advertising. I hope they don't treat others the way I was treated.

Don't be afraid of these big companies. Too many "little" people just walk away and the "big" people get away with it. I didn't use a lawyer, I represented myself. It's easier then people think.

Not familiar with small claims in Canada, but is it binding, or can they appeal? If it is not binding and you were awarded the full amount in your claim, then I wouldn't count your chickens before they hatch so to speak. If it was a more reasonable amount (ie. hotel costs and court fees) then I could see counting this as a win.
 
It is binding and it wouldnt be worth their time to appeal. We had a conference settlement which means both parties come together with a judge to try and resolve instead of going to trial.

The judge gave them 2 weeks to pay up or else the amount they owed me would increase. So its in their best interest to pay up. The judge praised me for taking on such a large company and said alot of people don't do that. Many just walk away.

Word of mouth is the best form of advertising and I will make sure everyone I know of knows my story and what "my opinion" of Air Transat is - they can form their "own opinion" after hearing what I went through. It's not slander if it's the facts of the story and "my opinion"
