FSBO Contract Question

My Dad has a condo for sale that I listed as a FSBO. A gentleman came by on Monday and made an offer today that I accepted. In your opinion, whose responsibility is it to complete the contract...the buyer or the seller? We sold a house in February, and the sellers attorney completed the contract and it went through to our attorneys for review. I don't know if that is an isolated incident, or the norm. If anyone knows the answer...it is you DISers!!

In the past when we've purchased a home, usually the seller insists on creating the sales contract. Seller offers; buyer accepts or rejects.
 
Seller offers, buyer accepts, consideration (earnest money) is given, contract binding.

You should have a lawyer looks over the docs, the few hundred $$ will be well worth the peace of mind.
 
Depends what state you are in.

When I lived in the east and we used lawyers, generally the seller's attorney prepared the contract.

In Arizona, we don't use lawyers. The buyer's real estate agent prepares the contract. If you were doing a fsbo here, the buyer would either prepare or have an attorney prepare if they weren't using an agent.
