Looking up the patent 9266028 it seems like this is related to the elevator sections of Transformers. I think a lot of suit is going to revolve around how the screen is built in the drop section. If the screen is attached to the drop cage they might be able to argue it is different. If screen is attached to the building then it will be harder to fight. It's hard to tell how it is in videos.
I would assume the reason it took so long to file is because it took awhile to confirm that the ride system is similar to his.
Sadly if he asks for continuing compensation Disney could just close over the "window" of the drop pod and problem solved. Worse rider experience but savings for Disney.
These patents - even as much as they look like an infringement - can be very difficult to defend. My old company stopped filing for them because we were spending way more money trying to defend them than we ever got back. Good luck to him.
