Foreign workers sue Swan and Dolphin, Westin Imagine for unpaid wages

If they were payed every 2 weeks I think I would have quite after the 1st payday. so they would not owe me for a MONTH
 
1) Why should the hotels be held liable if employment agencies don't pay?
2) I can see it if the hotels did not pay employees.
3) But I would be sure that they paid the contractor.
4) it was the contractor who did not pay THEIR employees.
 
Exactly, this lawsuit will go nowhere. It is the equivalent of having work done at your house, you pay the contractor, but he doesn't pay the sub contractor (who you never had contact or agreements with) and now the sub is trying to get you to pay again.

Not to mention, if the contracting agency is being investigated on visa's and other matters, are these foreign workers even legally permitted to work in the US and are they potentially opening their own can of worms.
 

Every company that outsources does it so they can deny they were aware of what the 3rd party was going to do with it's employees. It's the best of both worlds, they don't have to follow laws and when it hits the fan they can say , "How were we supposed to know?". I'd like to see the laws changed.

The laws have changed. If the INS can prove the contracting company (the hotel) worked with a company they knew or reasonable ought to have known was employing those not eligible for employment in the US... that company can be charged with INS violations.

It's happened to Walmart in fact.

It still doesn't put them on the hook for paying the wages twice.
 
I don't think the resorts should be responsible. Those people should be going after the company that hired them, not the company they were placed at.
