Ebay: Does this auction seem strange??

He's sold these before, and with an average selling price of $10, why not? Doesn't cost him a thing, and he can just sit back and rake in the cash.

I would imagine the people bidding aren't going/can't go to WDW and just want something to look at.

Dan Murphy could do this easy. :)

Look back at the rest of the auctions he has - he's sold maybe 100 of these in the past few months. At at least $5 a pop, that's $500

Yeah seems weird, but people ARE bidding on them...

I can sell my pix too "Oddball family photos of kids making strange faces and little ones jumping around so the picture looks fuzzy. Also included will be some video of the inside of the rides when the camera accidently got turned on... see what the underneath of the seats look like! WOW Hurry! Dont miss this!!"

Hey, Fantasmic, I have to disagree with your tag. I am Tiggers greatest fan! ;) Hee hee!

It does seem like a weird auction to me too. There are tons of places to see great Disney photos for free all over the net!

Maybe this guy is the one who does the Disney Flasher videos??

I don't think it's all that strange what's the difference if you buy his photos or a souvenir picture book, they don't appear to be family photos, just disney photos.. being a photographer myself I have family photos from WDW and I also have thousands of scenic shots/ and show/parade photos...

when my daughter was working down there I put together a book of 8x10s of parade and character photos for her to get autographed, and quite a few cast members wanted to buy a similar book from me...

I contacted Disney Legal Dept. and they said I could sell them to cast members but if they showed up on ebay they would be unhappy and try to stop me

All Disney buildings are either copyrighted or trademarked. Believe it or not, it's probably not legal for anyone to profit from the sale of vacation photos of WDW.

according to what Disney Legal told me,,and based on my knowledge of Photography law,,the buildings although private property are in the public domain..

since a photographer has the copyright to his photos, and they basically give you permission to photograph the buildings and such by allowing photography/ cameras in the parks..it would be a tough fight for them to stop the sale...

Disney does take their trademarks and copyrights very seriously. If you check the VeRO (Verified Rights Owner) pages on Ebay, you can find that Disney has a presence there. Their guidelines prohibit practically any way for an individual to profit from their intellectual property. Although Disney generally does not prohibit photography at their parks, the use of those photographs commercially is not allowed. I would imagine that this extends even to someone who's only making a buck or two on Ebay.

During MouseFest 2003, someone asked Bob Sellinger (author of The Unofficial Guide to WDW) why there weren't any photos of WDW in his publication. He explained how Disney had trademarked or copyrighted the design of EVERY building and structure within the WDW complex and that they could not use any images that could be identified as having been photographed at Disney.

My own rule is to never mess with Disney.

I agree 100%, that's why I've never sold any of my photos

but Disney legal themselves told me they'd "TRY" to stop someone selling pics on ebay,

they'd most likely win because they have the money to pursue it further than the average person, if someone were to challenge them and win, I'm sure that person would be banned from all disney property thereafter..

I'm having trouble finding Disney on the vero page, can you point me in the right drection

Compared to some of the things I've seen for sale on ebay these aren't too weird.

Nothing surprises me on Ebay anymore - they've got everything from toilet paper coupons to a guy selling his grandma's nude photographs - the only weird part about it is the people buying it. Maybe those people buying the photos can scan their own images in the photos - then brag about their "trip to WDW". Who knows?

I've made a fortune selling Granny's nude pics!!

I'm willing to bet that if someone brought this guy's auction to the attention of ebay, mentioning some kind of Disney trademark violation, they'd pull them. Most of the time, stuff like this can fly under the radar, but all it takes is a complaint from someone and they'll yank it and refund the guy's listing fees.

The weirdest thing I've ever seen onebay was a ziploc bag filled with air that came "out of", what was described as a "hot woman". I still have to scratch my head over that one.

I am a pin person and there have been people for years making pins using Disney characters/buildings etc. in silhouette and in some instances the image itself. These people have been reported to Disney and they do nothing.

Now not all these peope list theirs as "fantasy" or "bootleg" some give the impression they are Disney copyrighted pins and the vast majority of the time Disney does nothing.

So while they do it sometimes I don't see especially in this arena any enforcement of copyright infringement.

I won't link to any of these auctions because I don't believe these people should make a dime misrepresenting their item.
