I would like to let everyone know there will be frequent updates as to how this transaction proceeds. I am shockingly the winner of this unit. Along with Tony I really didn't expect for the auction to close at 13001. I went to a party as well and that top bid was there for several hours prior to closing. It was also my max bid. I have seen recent weeks on the ROFR thread that have failed for more than this amount.

UPDATE #1 - We are currently discussing / negotiating closing procedures. The first hang up is this guy is not ROFR literate. He just wants payment so he can record the deed. He still believes that because he is a charity that ROFR does not matter in this case. Emails are being traded as I write this. Stay tuned for the next episode of "Is it a bargain or not"
 
Congratulations. Hope it works out for you. Either way, a charity is getting a nice monetary boost.

I did try to contact you via ebay, but I'm not sure if it went through, so I wanted to contact you here as well.

This is the most interesting thread in a long time! Glad to hear that it's all in the DIS family....and thanks for keeping us posted.

Some people watch soap operas.....we get to see what happens in the next episode of ....."Vero Beach, ROFR or not?" Or, "The Real Players of Vero Beach ROFR". :sunny:

Well, it has been strangely quite for someone who emailed me twice this morning. My last request was that he needed to contact DVC so that he understand their ROFR process. I also requested that their be a seperate closing company at bare minimum for the financial side of the transaction. I would prefer the whole thing, but either way I am protected.

I am guessing I won't hear anything additional back until Monday.

As a side note I would like to remind everyone that all EBAY auctions for real estate and timeshares have that wonderful little disclaimer that does not make it an official purchase but an opportunity to enter in to a good faith negotiation for purchase. I really want these points and who knows, maybe DVC will let it go because it is going to charity. I think we all know the likelyhood of this is pretty slim but here's hoping.

I do remember that we had a member a year or so ago who sold her VB points on E-bay. If I remember correctly, they sold below the ROFR threshold, and still passed. It seemed that DVC didn't really want to get involved in the E-bay business. I'll keep my fingers crossed for you.
 
It gets even a little more interesting. The seller is kind of insisting that ROFR does not really matter. I am actually concerned that they are not the actual owners at this point because they did not officialy go through a change of ownership with DVC. Either way, I am seriously considering a title policy at this point.However, with a points based membership that may not be a possibility. Here is his most recent reply:

This timeshare was not sold by the original owner who had been forced to sign ROFR, it was donated to a IRS 501c3 charity. It is the charity that is conveying it to you and as a secondary owner no ROFR exists. No resort has ever interfered with the IRS and is charitable donation regulations but that does not mean that Disney will not try to buy it for the $13000 but I don't think they will interfere.

This is in response to me requesting/demanding that we can not go foward until proper ROFR paperwork is submitted to Disney.

I cant wait to read/hear any comments you may have as I am not real comfortable at this point.
 
Sounds interesting. Either the charity does not even properly hold title at this point, or possibly Disney waived rofr in the same way it does when parents pass it on to their children. Either way it seems that rofr would apply (and Disney might exercise it) during the sale to you.

You can get title insurance---I know we did during our resale purchases. As the buyer you can choose your closing company---maybe you insist on getting one that knows what the heck they are doing with Disney (such as TCS).

I'm not too sure how ROFR works, to be honest, but is there a way you can contact DVC yourself to discuss the validity of this whole thing? "Charity" and all? :confused3

I too think you should contact DVC directly and ask the ROFR question specifically in this case.
 
To be honest, I won't be surprised if this passes ROFR. I'd get the deed info and DVC member number and call DVC admin about this, maybe as a 3 way call. Also get as much info as possible about the sellers and how the deed is set up so you can check with the country records department.

The seller has finally agreed to at least get the unit in the charity's name. The deed has already been recorded but no paperwork has been sent to Disney.

This was the last response:

Disney may not interfere with the charitable donation process established by the IRS. The deed from our donor has been returned by the county recorder and we are sending it to Disney tommorrow to transfer ownership. They are not a charity and cannot issue form 8283 for tax deductable donations therefore cannot match the offer recieved by our donor. They may try to block usage by our charity after legal title has been conveyed or try buy the timeshare from us prior to us selling to you but nothing can put your purchase money at risk.


It will definately be interesting to see how this turns out
