Looking for some input from ebay regulars.

I recently won an auction for a 'new but not in box' item. I won the auction on Oct 31 (Sunday),
mailed my money order on Tuesday, Nov 2 (seller could no longer use paypal because of reaching limits).
I started communication on Nov 8, asking if payment had been received.
After 3 emails, I get email stating they would check to see if they have received payment and let me know status of shipment.
I promptly email back that they had received the payment because my bank verified that the m.o. had been cashed.
Nov 12 I get a Track and Confirm email saying it is being mailed.
Item arrives today - it is not new, most definitely used.

Here is my question.... my seller has yet to leave feedback for me and I have 100% positive feedback. I believe this buyer deserves a neutral or negative because of the misleading auction, as well as the slow shipping and lack of communication, BUT I don't want to sacrifice my feedback (why do all sellers wait to leave feedback? I deserve a positive for quick payment and lots of communication despite a change to his auction).

What would you do? Skip it and do no feedback? Leave neutral and hope he will not retaliate?

As a side note... he included a note in the box stating that he will be awarding one $10 gift certificate per month to the buyer who leaves the most creative and charismatic feedback for him. :rolleyes:

Ugh- looks like a bribe to leave him positive feedback!!

Have you tried contacting him via email on the condition of your item? What is his return policy?

I would try to resolve through email and if you hear nothing back, respond via negative or neutral feedback. If he leaves you a negative or neutral, can't you respond to the feedback and then it would show up for others to see? Unfortunatly, there are some shady characters out there and it is our duty as Ebayers to let other potential buyers be aware of them!

Did you email him about the condition and try to work things out? That is what I would do before leaving any feedback. I he is unwilling to work with you and it was false advertising....he said new and it was used....leave neg feedback.
 
I agree with my fellow poster. Try to have the item returned or get a partial refund. I had an item once arrive to a customer completely destroyed by the po. I found a bran new one on-line and purchased it and sent it to my buyer at my own expense. The seller has to make the buyer happy, whatever it takes. Leave negative feedback if you can't get a satisfactory response. By the way, I HATE IT when sellers wait to leave feedback until after the buyer has left theirs.. seems cheesy to me.

Good luck. Be kind but speak truthfully in your emails to this seller.
 

Also, if he leaves you a negative you have the opportunity to respond. If you can't get a refund I'd feel obliged to leave a negative. Good luck.
 
Thanks everyone. I have sent off another email. Hopefully he will respond, and we can work this out. I would welcome a partial refund, if it works properly, or a replacement.
