E-Bay, WWYD?

I have a good friend who lives in the UK. His wife has a Cricut and apparently carts cost an arm, leg and first born over there. I offered to pick up what he wanted and he'd send me the money. No problems there.

While browsing E-Bay I found 2 on her list (Animal Kingdom and Tear Drop) listed for $34.99 each. The ad showed them NIB, including the plastic outer thingie they come in. Bought both, got combined shipping etc.

They came yesterday - they are not NIB - they're opened. I can't send these to my friend - they're expecting NEW. These are clearly not new. I sent an e-mail to the seller with my dissatisfaction but I don't know what else to do. I can't just eat the $78 (and I have tear drop already). I don't know what to do.

What did the description say? If it says NIB, then you can dispute the auction. If it doesn't say so, and it is just the picture, then you can only hope the seller will take it back.

They have to provide you with a refund since it is NOT what they described. If they give you a hassel, you can dispute it through PayPal (if you paid that way).

playing devils advocate here. NIB means new in box it could be opened but never used, NRFB which is Never removed from box means it has never been taken out, typically still in original packaging.

Now that being said if the photo was of the packaging with the cellophane still on then I would dispute it.

may I ask why your friend won't take them if they have been opened as long as they still work? Also keep in mind I read on the Cricut boards not to long ago that there have been some box mix ups, outside says one thing and the contents are different.

I'm not trying to be a pain here, just giving some food for thought.

Good point. I just always assumed it meant never opened.

The box will be easier to mail without the hard plastic wrapper.

As someone living in the UK (the cricut costs £279 - yes, about $560 - I'm sure the carts are similarly expensive) as long as it works I'd be happy. As postal charges are high I'd probably be happy with just the cart and the instructions (as long as the packing was adequately protective - I hate paying postage on stuff I then throw away!)

Having said that, my DSis just bought something (a book) advertised as "as new" and the cover was ripped and it was marked inside.

Why not e-mail your UK firends and see what they say? If the carts aren't in plastic you could test them and let them know how they work.

That's what I was thinking. I am just annoyed that it was photographed one way (as if you pulled it off the shelf) and was sent another way. Since I do have the zoo swap it wouldn't be a hardship to test the Animal Kingdom cart

I always take NIB to mean brand-new, never opened. I would dispute, but that is just me. Anytime I have purchased something NIB, it has had all original packaging. I have seen some items listed as New but the description would say something like, "Item is not in plastic clamshell but has never been used and comes with game and manual." I would then have all of the information I needed to decide whether or not I wanted to purchase that item.

By posting NIB in the title and showing a picture of the item with the plastic clamshell, the seller gave the impression that the item came that way. They should have mentioned in the description if the clamshell was not included. At the very least, your complaint should make them change their listing.

Thanks Shauna. I have not received a reply from the e-mail I sent on Thursday. That itself is almost enough to make me open a dispute, but I'll e-mail one more time tonight and give him til Wednesday to reply.

Just an update, I did dispute, and today Paypal ruled in my favor. I need to send them back with DC tonight and I'll be refunded my money.

That's the trouble with Paypal, a real pia trying to get an asnswer. And don't even think about trying to find a real person
