Dvc ?

I have been curious about this from time to time, but have never done anything about it....wondering if anyone else might know?

My mother and step-father bought a DVC...must have been the late 90s. My mom passed away in 2003. To make a long story short, let's just say that I no longer have contact with my step-father.
I do know that my name was on the deed to their DVC. Do I have any rights as far as using it, etc?

It would be helpful to know in what capacity you're on that deed. (? associate). Also, if your mother passed with a will, was this mentioned in that at all?

If your name is listed on the deed, you are an one of the owners of the contract. As an owner you have every right to use it. The only issue could be any agreement between you, your late mother and step-father as to usage.

If your name is on the DEED ,then i would think you have every right to it's use. If you don't ant to get in touch with your step-father ,than maybe the county Of Orlando could help.

This thread has a bunch of various information about names on deeds. Seems you are a full owner of the contract if indeed your name is on the deed (that is, the real estate deed). You can find that out by doing a search on the county assessors office for Orange County which has the recorded deed on file.

Thanks so much for the info so far. I was able to find the deed in the records and my name is listed with theirs on the deed.
Going to start with calling DVC and see what info I can get....

Thanks. Yes, it is interesting! Turns out I am an owner! My name is on the deed, I am not an associate, so I was told I have every legal right to use it. Considering that I haven't used it and my step-father has, obviously he has been paying the yearly fees. I am hoping to change this, and hope he will allow me to buy him out, or at least have a lawyer look it over and draw something up that will give us each half usage if he doesn't want to sell his part to me. So maybe I will be a full (or half) dvc member soon! Thanks for the advice!

But if you haven't paid any dues for all these years, he has full rights to use the points. If you split the dues with him, you should have access to at least half of the points.

Correct, I would pay half the dues in order to use it. However, I haven't used it in all these years but should have had the access to it. Technically, I "could" go on to the site now and use whatever is there for points. I won't, and at this point I would rather try to buy him out than to trust that if I pay for half of the dues, he won't just go ahead and use all of the points anyways.

Just to be safe it would be wise to check with an attorney regarding this issue as it is part a of your mother's estate which may yet need to be settled. As inconvenient as it may be the attorney may be the best option for communicating and resolving this particular issue with you step dad. It was quite a headache when my mother passed away. It took years to get things resolved.
