DVC contract question

We are interested in purchasing DVC in the future and DH, being very particular, would like to see the contract ( basically any DVC contract ) to look it over. He's difficult. He's an attorney.

We cannot find a copy anywhere online. So do I correctly surmise that as a member you are not allowed to release copies of your contract anywhere public??? (even with the names whited out/blacked out? ) We went to the DVC office at SSR on our last vacation and thought we were given one from a "guide" but all he gave us was the promotional book. Not at all what we were looking for.

Any guidance on this issue would be appreciated. Thanks!

If you met with a Guide, that person is currently assigned to you. Contact them and make a second request.

When you agree to purchase DVC and given them a deposit, they fedex you a large box containing the contract and other legal paperwork. You then have a reasonably long period of time to read all the paperwork, and either choose to sign, or not. If you decide against joining, you get your full deposit back.

Because they give you plenty of time to review the contract and other documents after they mail them to you, I don't think they'll be willing to send you all the paperwork just so you can look at it before deciding to put down a deposit.

Depending on how far in the future you wish to buy, the contract may have changed by that point anyway. If they won't send you a copy of the contract now, your husband can talk to your guide about any concerns he has. They're quite willing to answer questions, and mine, at least, was very knowledgeable.

You can also ask questions here. There are a lot of extremely knowledgeable folks around here, who can discuss any of the technical and/or legal details of DVC at length.

DH and I are both attorneys and didn't see the contracts until after we put down the deposit. Honestly, it is like a contract with the bank or your insurance company, it isn't negotiable, it is a take it or leave it kind of thing. You obviously need to know how it works, what you get and what you have to do but it isn't like they are going to change a clause for you if you don't like it. Disney has a lot of power in the DVC contract but there are many of us who still feel that it is a good deal for their family regardless.

Thanks for the help! While I am not surprised Disney wants your deposit before releasing the contract, I am surprised that a copy of it isn't floating around out there. (with pertinent info blacked out) Interesting. This will make it harder for me! And not being able to dot any "i"s and cross any "t"s will drive DH nutty. General contracts can be the worst!

If you are planning to buy on the resale market then you will not get any of the original paperwork unless you are successful in getting the original purchaser to send it to you. I can't imagine a seller being willing to give it to you until after the sale goes through, at which point you are already committed anyway.

I think the reason you don't see copies anywhere online is because the box from Disney contains maybe 30-40 pages of information. That would be a lot of pages for someone to scan and post just in case somebody else might want to look at it.

You know the scene in Empire Strikes Back, where Darth Vader tells Lando, "I am altering the deal; pray I don't alter it any further." That's pretty much our relationship with Disney. Disney can do almost anything they want to us; we hope they treat us fairly (so far, they've done that.) And even where it seems we have a few rights, keep in mind that the membership can vote to change things. And that we don't actually vote; our proxy votes for us. And we've picked Disney as our proxy.

If contract language is a make-or-break issue for your husband, don't be surprised if it's "break".

That is a PERFECT summation of our rights as owners! Still love my DVC though!

call your guide and ask for a copy of hte POS. It's not a trade secret and is filled with the state of florida. While it's somewhat fair, it's written in Disney's favor and as noted above, they can pretty much change MOST anything on their own without member input. To be honest, it might actually be better for you if he doesn't see it ahead of time for this reason. One thing with timeshares is that it ultimately comes down to faith, not matter what the POS and Rules and Regulations say.
