Does anyone have experience with a Protective/Restraining Order (50-B) in Court?

No knowledge of restraining orders, but good luck. It's a sad comment to our society when a 16 year old needs to get a restraining order against an ex. I hope it works out for you. Please keep us updated.


Thank you very much. I have to say it is so easy to fall within this cycle and allow it to happen. Unfortunately for us we tried to handle it on our own and did not press charges when we should have. Now we have to pray that the judge will see that this was a cycle that not only our DD fell into we also fell into it as well. It is nasty and ugly to have to deal with. As you say no 16 yo such have to go thru this. She is such a good child. Everyone will tell you how sweet she is. It breaks a parents heart to see your child so beat down by someone. It has been a very hard time for us.
 
Someone asked me to update the situation.

I did call the Domestic Abuse Advocate. She had to call me back on Tuesday. I have to say it was somewhat of a relieve to talk with her. My DD spoke with her as well. I think we know what to expect and how to handle the situation. I am glad to know what could happen at court and be prepared for various situations. She was able to help me not blame myself on a lot of decisions we made at the time. Hintsight ... wish I had it before hand, of course then it would not be hindsight, right?

Each day I can see my daughter becoming more the child she use to be 18 months ago. I pray she will continue down this path to healthiness. She is a very strong girl and so very sweet. It scares me to say I see her becoming my daughter again, the one I use to have because I am terrified she will revert back to making bad decisions.

In one week we should know more. DD has told us some things in the last 2 days that we will attempt to use. If the judge allows it we really have a very strong case against all 3 of these people.
 
Do you guys have an attorney?
You mentioned you have letters from nurses and the school officer...I do not know about this specific kind of hearing, but in all cases I know of a letter is not considered acceptable to be admitted as evidence. You would have to bring in the actual witnesses to give their testimony.
Maybe the domestic advocate can clarify that for you before your court date. I would hate for you to get to court and have a lot of your evidence disallowed. As another poster said, the burden is on you to prove the case.

You are right the letters are not allowed. The advocate has told us we have a very strong case.
