So back in September i got a promotion and moved to another Department........My pay increased and up until now I had been cashing my paychecks as if nothing.........Well I was just advice that a error was made and I was overpaid $240.00(it added up to this amount). Now they want to take it back all in one paycheck........Do I have a right to say anything?
 
I don't know what rights you have, but it can't hurt to ask if they would take a % out of your check until it's paid.

call a lawyer.. they normally dont charge for a consult...
i think they aren't entitled to take it back from you at all

I feel if it was me, I would ask if the COMPANY could take it back exactly the same way they gave it to you!!!

What I think is, it really is not all that much money...why do they even have to take it back, after all it was the company's mistake, you know...:confused3
 
That is how my job does it. You were lucky they told you, just this week I got wacked that much and had no warning from my boss :mad: It never happened before in 17 years so I shut up about it, but I was mad at him!
 
Unfortunately, I'm pretty sure it's 100% legal. By law, you are the ultimate responsible party for making sure your checks are correct, whether it be in their favor or yours. If they had stiffed you $240 each time, would you ask for it back all at once? Probably so.

Now, before anyone flames me, I think the NICE thing for them to do would be take it out of each check the way they gave it to you. Or even less at a time, until it's all paid.

I guess you can just be glad that there's time to get you a correct W2. Had you already filed taxes and gotten money back or paid, and then the company realized it, you might've had to file an amended tax return for the previous year.

Honestly---I don't think you do. It was an error and they caught it and they have a right to fix it. I was overpaid for a job that I quit (I was salaried--so got paid for a few extra days or something). I set aside the money and as soon as payroll caught it, I did have to remit the full amount that I was overpaid.

As for that what if they underpaid you bit...

Hubby worked out of state, so they set him up for state income tax withdrawal--well, they forgot to turn it off when he returned to Florida (We just didn't notice it for a long while). He mentioned something--it was immediately fixed and every penny that was missing from his checks....showed up in a check all together.

It would be nice if they took it all out gently--but it is your responsibility to make sure everything is accurate.
 
By brother had quit his job and wound up getting an extra pay check from his company after he had left. About a month later they cuaght it and have asked for it back. I don;t think he has any right then to give back that money unfortunately
 
When you sign up for direct deposit with your employer, you must sign an authorization indicating they have the right to deduct as well as deposit. I wouldn't say anything about the $240, but I would make certain from this point forward that you check each advice when you get it. Your employer is not a bank (unless of course, you work for a bank) and they are not in the business of making employee loans.

We had an employee who was oeverpaid by $2000 on a Friday and noticed the error Monday, and wanted to know if they could take it out of her checks $100 at a time until paid back... give me a break!
 
I think there is nothing wrong with asking if they could deduct the amount out of several paychecks. If we ever overpaid someone and had to get the money back, we would definitely have no problem with deducting it out of several paychecks. And yes, if you are overpaid, the company can deduct the pay from your check. Since it is their mistake, they will probably be able to deduct it out of several checks.
 
This is a very common problem with military pay. I know with the Navy, you get promotions, pay raises, changes in COLA and housing, deployment and specialty pay.....it is almost impossible to know if there is an error in your pay because it is never the same from paycheck to paycheck. Then, many years down the line, they audit you and heaven help you if they realize they overpaid you by more than a thousand dollars. Guess what? They take it all at one time! THey don't care if you have NOTHING left for groceries or rent. They want their money and they can legally take it anyway they want.

not like you owe them $240. The govt owes them some for
the taxes, FICA, etc.

So, your portion should be somewhere closer to $160 or so.

That would depend if the $240 was a before tax number or after tax number.

When I had to reimburse my pay to the company for overpayment--I only paid what was actually cut.
 
An aquaintance of my DWs was overpaid about ten thousand over a year or two (can't remember the details) She talked to a lawyer and they settled on taking a small amount every check. But the lawyer added some wording that said if she was fired (whic happened only months later) she did not have to repay!
