Ok crunch time in that I told DH today that we needed to finalise stuff ie finances and divorce! We talked about things and can happily manage the divorce through the county court oursleves it is just the financial bit that I think needs, for both our sakes, to be done properly and legally binding. So without too higher cost what is the easiest way to do this?

The D90 form has a phone number on there for Community Legal Advice that you might like to try.

Or you could try your local Citizens Advice Bureau - some have an appointment system to see a solicitor who can give you some legal advice (though may not actually do the work for you.)

Also, some solicitors offer a "fixed fee" interview to start you off with some advice so you know what you will be paying up front. I don't know what your financial situation is, but you could also ask to see if you are eligable for Legal Aid.

You are very wise to do the divorce yourselves, especially if you are on good terms with each other, as you will save a ton of money and it really is straight forward. There are lots of leaflets at the County Court, plus they are all on-line, to help you. Just take it one step at a time.

Have you thought about a mediation service? My ex and I were advised to use one through our solicitors (I wasnt earning much then so my legal fees were really small).
I ended up paying for my side of the mediation (around £250) but because he didnt provide any books as he was self employed he got away with it! ggggrrrr

However all that aside we were able to divide things from the house up properly as the mediation service were looking over our shoulders and things were divided up financially fairly well too.

I dont suppose we're ever happy with whatever deal we get, but I managed to keep the house for me any our son by paying him off (a largish sum I might add). (But I sold the house to move in with my new (and fabulous DH:thumbsup2) 8 years later and made £100,000 - so i was quite happy in the end with my side of the deal:rotfl2::rotfl2:)

Keep your chin up - you're making decisions for you which is the only thing you can do.
I am living proof that there is a (much much much) better life after divorce - even if life wasnt that bad before hand!:rotfl:

Theresa did work in the County Court Service for twenty years so she should know a far bit about it.
 
Claire honey - Darryl is asking us to go to mediation 'because it's cheaper than lining the pockets of solicitors'!!

From what I've discussed with my solicitor, we have to go armed with all our finances to the mediators (who are trained and fully qualified legal advisors/solicitors) and they sit impartially and decide a fair and equitable division of the assets based on need (ie I've got Katie, but it should, I'm guessing be pretty much 50/50 for you and Nathan).

You then use a solicitor to look at the Mediator's findings and, if the solicitor thinks it's a fair offer, then they will 'sign it off' for you.

Thank you for all the advice. We know how we are going to divide things up ie equity 50/50 so just need it written in a legally binding way. Not sure how mediation can help further when we are both happy with this agreement?
