Well I can see why the guy chose the spot anyway. But for sure looks off limits.
There is a much better spot that's also off limits and usually not guarded by CMs (especially not close to show time).
If you go a little bit to the left of the castle, there is a hill with a view of the castle. You cannot get there unless climbing over a fence, this is where they do promotional or celebrity pictures. They can do promotional pictures during the day as you can position the camera that you are in front of the castle with (hardly) anyone in the background. No need to do it before or after opening hours.

If you are going to break the rules, do it right!

I've never been to DLP, but I've read reports this is a widespread issue. Even watching the live streams from the Park, you see guests sitting on rocks, fences, etc. that you know are off-limit areas.

But the lack of respect is not limited to DLP.

When I was at World in December, I saw people letting their kids in the gardens at the hub. They were trampling all over the flowers and taking pictures by the 50th statues.

Seriously? That's why we can't have nice things.
The thing with Paris is, in France it's really common that in a park you can lie down in the grass everywhere. As Disneyland Paris is more set up like a park, there are several grassy hills with a lot of shade. It happens that people lie down and relax during the day. 95% of the time it goes well and people understand 'fence = off limits', but there is that 5%.
When they know it gets crowded, during the parade, fireworks time, they usually have a CM standing in the grass as well to keep people out.
 
In Disneyland Paris now, I took a picture of the stage where it happened. This is 30 minutes before showtime.

The show is adapted today as it is about 95F degrees here. It is the parade part only, no show at the hub. So I can't check when they open the gates. But what normally happens on the left and right of the green lines is where guests can stand. This show is very good and therefore popular, as of an hour at least before showtime fans start to gather.
The path in the middle is where the characters and dancers go by, so before showtime this area is cleared like with a parade. No crossing unless a CM tells you, you can.

When the gates are opened and you try to get on stage, you are surrounded already by a thousand people. When you get on that stage, the entire hub can see you.
If a CM agreed to let someone do this, he/she has to take people out of a crowd. This cannot be done without other CMs seeing it.

The websites are still active, but what they're offering right now is extremely limited. It's basically just limited to a private photo pass session, communication with the restaurants and flowers/gift baskets.

You can still buy Disney branded engagement rings too, but that's about it at this time. A lot of the stuff hasn't come back yet.
 
Then I guess I will default to your expertise of Parisian law. If that had happened in America, the story would more likely have been the couple getting escorted off property and a lifetime ban, but maybe France is different.
 

So it appears all my comments in this thread where I said the cast member overstepped were deleted for some reason? It appears the rebuttals to my points were left so I’m baffled as to why they would be deleted.
 
Did you mention things in those posts that were already thoroughly discussed elsewhere? That's the only reason I can think of. I don't recall anything you said being explicit or offensive.
 
Honestly the whole discussion has probably run it’s course, I had seen that this got bumped and it felt like people were back to debating stuff like what sort of permission he had and I guess it got testy enough that the mods stepped in, seems like nearly all of the posts got deleted.
 
If the couple was in the wrong why did Disney apologize and offer to make it right?
 
I'd still like to know the "real" story: did the couple have super-secret-special permission? Did they indeed "jump the fence" What's the real deal here!

I have been to DLP and it is way more relaxed than US parks. I've seen guests on trash cans watching the parade and in the grass with blankets and coolers. It appeared to be acceptable. If my memory serves me correctly the fence is very low and easy to step over.

Because it was already enough of a PR mess and there was no reason to inflame it further.
I believe the cast member was overzealous and acted inappropriately...very extreme. IMO I've seen guests come to blows with no interaction from cast members whatsoever. Besides DLP is way more lax as a general rule than the states. I am pleased with the apology and offer to make it right.
