Disney has had my contract for 32 days...

and they haven't given me a decision yet pass or fail ROFR. Worse than that this is a private sale and I'm afraid I've screwed something up and now they're going to say sorry we don't have all the info...

I did e-mail them today so I'm crossing my fingers I'll hear something back. Just complaining I guess.

Hopefully everything works out for you. They have had mine for 21 days now and I'm getting a little anxious too since I've seen many recent postings lately going through at 9 or 10 days.

Someone correct me if I'm wrong...but I believe Disney notifies the seller (or the seller's agent) of their ROFR decision. I don't believe they notify the purchaser at all. We certainly did not get any notification from Disney when we bought resale.

You may want to check with the person you are buying from and see if they've heard anything.

As far as timing, I think they try to get ROFR done in 30 days, but they're not bound by that. Sometimes the process is quick. Other times they have a big crush of resales and it takes longer. Sometimes contracts have to be sent back for paperwork issues...there are a lot of things which could slow ROFR down.

I never said but I am the seller and I know of other contracts that went in later and have gotten a decision. I almost don't care if they want to buy it but I do want an answer...

And the paperwork thing worries me I'm going to be pretty frustrated if they've had it this long and couldn't let me know if something was missing before now. Just want to finish this process.

I think you should call Disney. I don't know much about private resales, but I have heard of brokers calling to find out what the holdup is and being told there was a paperwork glitch. In those cases, I got the impression that the faulty paperwork was just set to the side until someone called to complain.

If you're the seller, you have every right to call them and ask them what's going on.

It's not a simple 30 days that DVC has but that you must notify them at least 30 days prior to closing. Generally I'd recommend setting up closing as close to 30 days after you know they've gotten the info as possible. Technically if they don't let you know, you can then close without the letter.

Gosh, I was worried @17 days! (Went to ROFR 8/24) I, too, have seen ROFRs coming back in ONE WEEK! I did have to resubmit, but I was told it wouldn't start over for ROFR.

That's exactly what I was going to say. Sellers can (and should) put a closing date on the ROFR docs they send to DVD. If you make sure that the closing date is greater than 30 days from the day DVC receives the docs (you may need to send via registered mail), you can go ahead and start closing procedures on the closing date, even if you have not heard from DVC. This happened to me once when I was buying a contract. The closing date came and went, and we had not heard from DVC. The resale agent started closing, and notified DVC that their review time had passed, and that we would be closing on the ownership interest. I guess that got DVC's attention, because about an hour after she faxed the document to DVC, she received a fax stating that they had waived their right to ROFR (with that day's date on the waiver). I guess DVC knew they had overlooked this one.

However, had she not notified them of the closing date, and verified the recipt of the ROFR docs when she sent them, we could not have proceeded in this way.

Mine only took 2 weeks to go through ROFR but now I am waiting on the seller to return the paperwork and I am getting worried I hope they dont back out....I would hate to have to change my tag line with BCV I am also still on the waitlist with Disney and h ave been for months...I dont want to cancel with them until I have that title in my hands.

My last prospective contract (which Disney bought out form under me) took 11 days. A contract I'm selling is at 29 days today. I can't figure this one either.
