What’s a “Subscription?” Warner Bros. Discovery and ESPN Find Out the Hard Way

Dish Network leveraged ambiguity around the term in licensing deals with Warner Bros. Discovery and Disney to offer short-term Sling TV subscription passes.

A court has denied Warner Bros. Discovery’s bid to block Dish Network’s Sling TV from selling a suite of short-term offerings that allow users to sign up for as little as one day at a fraction of the full monthly subscription cost. The ruling, issued on Tuesday by U.S. District Judge Arun Subramanian, swung on what exactly a “subscription” means under the contracts and is the second in favor of Dish allowing it to continue offering the first-of-its-kind packages.

In August, Sling TV rolled out day, weekend and week passes, which don’t require subscriptions, that give viewers access to its bundle for as little as $4.99 and has popular networks like TNT, CNN and ESPN, among several others. In response, Warner Bros. Discovery and Disney filed breach of contract lawsuits accusing Dish of violating the terms of their licensing agreements.

At the heart of the dispute: the possibility of short-term offerings, like the one rolled out by Dish, undercutting studios’ longstanding business model, which is dependent on regularly recurring monthly subscriptions.

The mischievous alien starred in a billion-dollar grossing film, sold more than $4 billion dollars in merchandise, and took over for Mickey Mouse on a national tour.
Now if only they would put in a new (and better) Stitch-themed attraction where Stitch’s Great Escape was, although I wouldn’t be surprised if they decided to have the blue mischievous alien take over Disney World's Enchanted Tiki Room like in Tokyo.

I'd prefer it to be additive... Even with TRON, Tomorrowland could use some work...

Exhibition wants Netflix to commit to theatrical runs more, and the streamer will have contractual obligations to filmmakers once they complete their acquisition of Warner Bros. Stranger Things finale is something of an olive branch to exhibition, and a means for Netflix to experiment and dip their toes into the theatrical business. Netflix Co-CEO Ted Sarandos has waffled in his messaging on theatrical telling analysts on an earnings call post the success of KPop that Netflix prioritizes their first run movies for the service. Post Netflix firming up its bid for Warner Bros, Sarandos has changed his tune, telling the media, ““There’s been a lot of talk about theatrical distribution, so we want to set the record straight: we are 100% committed to releasing Warner Bros. films in theaters with industry-standard windows.” The town continues to worry what “traditional” means for Netflix. Sources have told Deadline that Netflix have been proponents of a 17-day window which would steamroll the theatrical business, while circuits such as AMC believe the line needs to be held around 45 days.

That part of the Deadline article is just speculation. I wouldn’t trust that source.
