I'm going with the idea that they are smart enough to figure out he is the best character from all the films (besides Boba Fett) and are making the toy just because...and not that he is in the new film.

Putting him in there sounds more like a Lucas thing than a Kasden/Abrams thing.

There's been rumors about a character that is obsessed with Darth Vader. Conjecture (on my part solely - haven't even heard rumors on this) that this character could don the Vader "costume". This could be a way for Disney to essentially "bring back" the character, without actually resurecting the dead (Anakin).

There's concept art of a villain who wears a mask and helmet that is a hybrid between Revan and Vader.
