Court summons for date we leave!!!!

Oh my gosh!!!! We are less than 20 days from departing on our cruise, and my husband just received a court summons to appear in court on June 10th ... the day that we finally sail on our first Disney Cruise! We have no idea what it is about and don't even know the parties involved, but for some reason they want him to be a witness! What if he can't get out of it???? Will we lose our money??? Does cruise insurance cover something like this??? We are all kind of panicking right now.
 
can you call the court and explain to them about your vacation. You may have to bring your documents there for them to see.
 
I just wanted to say good luck. All this waiting, you are so close to leaving and this icky turn of events. Yuck!

If a postponement doesn't work, see if the court and the attorneys involved would agree to having him give a deposition beforehand and use that in place of an in-person appearance at trial.
 
i would call the court and if you are only a witness tell them you will be on a cruise and wont be their they will have to reschedual the court date and send you another summons or try the case with out your husband DONT CANCEL THE CRUISE FOR THIS!!!
 
Actually we were just reading through all the insurance booklet that DCL provided us and I'm pretty sure we read that it does cover you if you are summoned to court or jury duty, but only that person (not the whole traveling party).

Thanks for all the good thoughts everyone. My husband is going to call the court house first thing tomorrow morning. I hate when you get something like this on a Saturday because all of the offices are closed and you end up worrying for days! Hopefully they will accept a deposition, but unfortunately, my husband has no idea who this guy is, he's never even heard of him. The summons has the guys name on it and says that the case involves DUI, driving without a license, and an accident. The summons was sent to my husband at our business, so all we can think is that someone had an accident in front of the store (it's a bad intersection) and thinks that maybe he saw something.

Hopefully they will just postpone it for a week, or just excuse him from being a witness! What a pain!
 
Call the lawyers and see if you can file an affidavit for whatever they need him for.

I'm not a lawyer, judge, et cetera, and don't know what I'm talking about, BUT....

Since he is neither plaintiff nor defendant nor juror, then he should be able to be accomodated.
 
I worked for lawyers for 20 years. Tell him to contact the Clerk at the Courthouse AND the law firm that filed the summons. He may have to send something certified, but they have to accommodate him. He is a witness, not a defendant! DO NOT tell them that you are leaving that day, but tell them that you will be away.

They can either reschedule his testimony or videotape a deposition. If it is an ongoing trial, they should be able to bring him in earlier once he makes it known to them that he will not be available on the date of the summons.

I hope everything works out for you!!! I am hoping I won't be in a similar predicament for our Dec cruise--- I was summoned to the Grand Jury & I postponed it untill November because I would have missed our last cruise (It said Grand Jury is NO less than 30 days AAHH) & If I am summoned again in November unless is is exactly 30 days & starts on Nov 1st, I'm in trouble!! Our cruise is on Dec 2!! I don't know what I'll do as they say you are only allowed one postponment. And the crusie insurance covers only me? So my bf is to go by himself? What is that about?? My DH is a police officer and he goes to court all the time...He said that you can contact the court and the attorney, and ask to do a trial by declaration. Basically give your testimony on paper. Most courts will work with you on something like this!

I still haven't had the guts to look through our cruise insurance to see what it will cover if we have to cancel. I will die if it only covers him. I haven't cruised in over 30 years, so in my mind, it's like I am cruising for the very first time. When I first booked this cruise, I had some major anxiety (What if I get seasick? Will I feel claustrophobic? etc) and now that I have finally calmed down about the whole thing and am getting excited, this comes up!

Oh well, we'll just have to wait and see what happens. My husband is going to give them a call in about 30 minutes. I'll let you know what happens.
