Copyright Infringement?

I was reading Caribbean Travel & Life, and saw an article about Carnival's newest ship, the Miracle .
They have a lounge called the Mad Hatter's Ball lounge, and their kids' club is called Pinocchio's.

Can they do that? Just curious.

sure they can - Disney doesn't own the copyright on the NAMES - because Mad Hatter is from a Lewis Carroll novel and Pinnocchio is also from a book, not created originally by Disney.

Regardless of whether or not Disney owns the copyright to the 2 names in question, doesn't mean someone else won't. So there certainly could be an infringement. Copyright/trademark infringement has much to do about the nature of the original product, and the nature of any other product named the same.

You will also find some cases where there is no copyright (for example, in fairy tales that were written centuries ago...have you ever seen some of the knock-off books about the Little Mermaid, Cinderella, etc. where the illustrations look similar to Disney but are not quite? Copyright is time limited, too. I recall a recent flap because some of the oldest Mickey Mouse cartoons were about to lose their copyright protection, but I believe Disney managed to lobby to get the time extended.

Alice in Wonderland was first published in 1866 and the copyright has long since expired.

I believe Pinocchio was published in 1881 and also has a long expired copyright.

Copyright does not have to be obtained or defended by the originator. Copyright/trademark rights do have to be publicly and vigoriously defended to have a valid claim.

True, but in the cases of Alice in Wonderland, Pinocchio, and most fairy tales, there's nothing to defend because the copyright has long sense expired and they are in the "public domain."

Now, although Little Mermaid is public domain, the "look" of Disney's Little Mermaid is copyrighted (so I'm dying to see how Shrek 2 pulls that one off!!!)

They can do it, but it certainly is a cheap gimmick. C'mon...."Miracle"? "Mad Hatter"? "Pinocchio"? I've always enjoyed Carnival's ships on their own merit. Do they really NEED to go that route?

Sorry to rain on the Carnival-flaming parade, but looks more like they're using a book/movie/mythology theme than a copy-Disney theme.
They also have Phantom (which is the theater), Great Gatsby's Garden, The Raven Library, Sam's Piano bar, Yellow Brick Road (which is the shopping area), the Adonis Spa and Venus Salon, Ulysses, Sirens and Orpheus pools, Odyssey Bar and one I can't put my finger on - Nick and Nora's (?). Anyone got a clue where that's from?

I just read that the theme for the interior of the the Carnival Miracle is "fabulous fictional icons."

There's even a picture of the Mad Hatter at the entrance to the Mad Hatter's Ball show lounge. And this Mad Hatter is clearly not based on the Disney version of Alice in Wonderland. A good friend of mine was on the second cruise that the Miracle sailed on in early April. They had an awesome time. I finally got a chance to see her pictures last weekend, and the ship is truly beautiful!
