Can i get some advice from you please. DD foolishly bought a set of curling tongues from a stall (not a proper shop) at our local shopping mall. Unfortunately they were on promotion at £85 :scared1: instead of £110. She is now regretting the purchase and wanted to return them for a full refund but they say because they are a promotion you can only have an exchange nothing was mentioned to us at the time we bought them but there is nothing else she wants. I personally don't think she has a leg to stand on so to speak but does any one else have any advice.
 
From what little I understand of the Sale of Goods act, the retailer is only obliged to offer a refund if the goods are faulty, not fit for purpose etc. Often retailers will exchange non faulty goods as a offer of goodwill but they are under no legal obligation to do so.
 
Where was that? We have people seling them in Touchwood and they are so pushy, they curl your hair with them first and then expect you to buy them.

It was merry hill. The problem is they are foreign and don't speak very good english and as you say are very pushy. At the end of the day we have all had an impulse buy and regretted later hopefully she has learned her lesson !!!!
 
I'm presuming its the stall Denise where they curl your hair?
 
We have them at the Westfield too. We also have another stall selling hand held massge things and the girls just walk up to people and start massaging them on the shoulders even when they have been told they are not interested.

Could you approach the centre management and ask for the details of the company to see if you can approach them direct if the staff don't speak very good English?

They ought to be careful there as that is technically an assault!

You could always give citizens advice a ring and see what they say.
 
I am afraid Fuse 04 is correct, legally the retailer has no obligation to refund your money, unless the goods are faulty. I work for the nations favourite department store, and we would, as a gesture of goodwill, refund them within 28 days of the sale. Unfortunately not all retailers are the same. It may be worth trying to get a refund. If that fails, you will probably get most of your money by reselling them on ebay, or other auction based websites.
