His "apology" blames Coldplay.
I have to wonder if he is setting up for a lawsuit of some sort.
Don't think he has a leg to stand on - but you can sue anyone for anything.

I also have to wonder what the companies policy is on something like this - he is the CEO and Id assume she reports directly to him.

And as far as Coldplay - best thing to happen to them in years.

Lastly - had he not reacted at all - this may have been missed completely. Obviously in the moment you just react, but that reaction is what made it go viral.
 
I guess the question is, what exactly constitutes cheating.

Holding a co-worker like that and then panicking when caught is definitely crossing the line.
If he's separated from his wife, then it's not cheating.

I'll wait for his official statement before jumping to conclusions.

Most concerts and sporting events now say somewhere in the fine print that you can be recorded or photographed, and have those recordings published on social media, in promotional materials, etc. That's along with all the "you can't sue if the lighting rig falls on your head," language.

No doubt. Like I said I don't think he has a leg to stand on - but I'm pretty sure he can still sue regardless of the fine print etc..

No luck needed. While he would be completely in the wrong if he sued, the cost of defending the lawsuit would be greater than offering a settlement. "Go away" money as it is known. In a lot of Civil suits these days, the issue isn't right or wrong, it is what the bottom line cost will be among the options.
