Does it make a difference in the ROFR process if you pay a higher PP cost but the seller pays the closing costs vs. Lower pp and buyer pays the closing costs?

No one really know what will cause Disney to take a second look. I think total price is definitely considered but where that comes from may not matter.

I think it really doesn’t matter either way since it will cost the same if Disney buys it, as I assume they have the pay the closing agent as part of the contract. The price you are willing to pay is what matters most. I prefer to get a good deal and don’t need points in a hurry so I make lowball offers unless it’s a perfect contract of what I was looking for. If you have a big trip you plan to take and want points vs paying regular Disney room rates, if it takes going a bit higher to sail through ROFR then it’s worth the few bucks to get your trip secured sooner.

Are you that close to where ROFR is an actual risk or just a perceived one?

This is an afterthought question. I put a deposit on a contract this morning and just preparing strategies for next time. Hopefully I wont need to worry though ;) My deal is a loaded double point contract (20,21,22 full points) at BWV for $140pp. There is certainly a chance that it will get taken.
