I know there are many child support threads out there. I subscribe to many. The only problem is they seem to disappear in the masses so I am creating a new thread. Here is my question.

I have been battling my ex for CS for YEARS. He would do everything he could not to pay. Finally, last October child support caught up with him and garnished his wages. This Feb he left the state. He had a relative tell me he left and good luck getting CS (no he never told DD he was leaving..although under the circumstances she was ok with it). Well I just received a letter, the other day, telling me there was an order to withhold his wages. I called my social worker and she stated he got a job, in the new state, but that was it. Now here comes my question....

Can anyone give me some insight on to how long it will take to finally receive a payment? He has a HUGE amount in arrears and getting a payment would be like Christmas.

The state computers are all connected now. So my guess would be, his employers pays his state, which will forward to your state, so about 2 weeks max. Once it starts, depending on his pay period, they will then come weekly or so.

Thanks for the reply. It would be great to start receiving it within a couple of weeks.
 
I also know that I have a friend who's taken her ex's ENTIRE tax return for close to 3 years in a row for child support he hasn't paid.

I am in Iowa, so I'm not sure how it works state to state, but she says "i'm done messing around playing his games". I'm not sure WHAT she did or HOW she did it, but I've seen the checks...and they are nothing to shy away from. Thousands in back support has come her way 3 years in a row now...

It's worth a call to find out how that works...
 

Hey. I remember your story from the other thread. What great news that they found your ex! My ex lives in another state way on the other side of the country and I know that it took roughly eight weeks for me to get the first check.

Hey I know you. Hopefully he will actually keep this job But if I know him like I think I do...once re actually sees his check being garnished he will stop working. I just hope to get a couple hundred bucks before he quits.
 
I hope he doesn't jump ship on this job and you have to hunt him down again. As said before about their taxes being garnished if they don't pay CS, DUH! I was one my DS just turned 18 and we were one of the lucky ones. His dad always paid the CS and I know is dancing a jig right now because it is ending. I just wish the state of CA would have made it so he had to pay through college (as long as he was going to college) for at least a few extra years. This is when it really gets $$$$.

If the state is taking his child support out of his check they will notify the IRS if he is in arrears. My DS was in arrears from the day he turned 18 and his ex-GF took him to court, even though he had been paying what they had agreed on. The IRS just intercepts his return and takes a percentage of it to pay some of the arrears. He is totally caught up but I know it happened for 2 or 3 years. Good luck OP, fathers like your ex give all guys a bad name when it comes to support.
 
The IRS will stop any refunds if arrears is over $500. In Ohio if arrears is over $250 they will stop any state refund. Ohio has a very screwed up child support agency :mad:
 
I can tell you that the best thing I ever did was hire an outside cs collection agency. It kills me that they get 34% of every dollar that should be helping my son, but it is far, far better than the 100% of zilch I was getting before. It has been at least 6 or 7 years now since hiring them, and the 34% has been worth it just because I no longer have to talk to the Attorney General's office, or track down my job-hopping ex.

Before, every time he switched jobs, I would have to wait and wait and wait for him to finally decide to maybe tell his new employer about the cs order, then wait for the employer to actually start withholding, then wait for the AG office to finally send me a check. By then, he had moved on again. If I called the AG office, they would ask ME where he was working. They said it was not their job to track him down. (!!!)

Now, if he changes jobs, the agency is ON it. I don't have to deal with it. And the agency doesn't have anything to do with this, but the occasional redirected tax refund is a nice surprise! Just 2 days ago I got a check for about $1800. It paid for all summer for DS in the Y's Teen Extreme program, bought him more guitar lessons, and got him a brand new and much-needed bike, with the rest going into savings.

Here is a bit of back story...MPA has heard it before. Ex moved from the state I live to live with his mother in my/his home state of Calif. He is living with his mom so hunting him down was not and will not be hard. His keeping a job is (esp since he usually works off the books). The IRS and state taxes did garnish his returns which was a grand total of 530.00.
