CHANGED TITLE - Be creative to pass ROFR!

Tom,
That was really sweet of you! I noticed that you posted to somehow else recently and tho I can't remember (CRS) exactly what it was, I do remember thinking it was so kind of the Timeshare STore owner to visit these boards and.....share our pain at ROFR!

And just when I thought I would never have to do it again...I just found out my timeshare contract for Paradise Village Resort in PV, Mexico is also a ROFL!

So thanks for checking up on us. The kind words are much appreciated!

To expand on Jim's idea, can you give the seller something unique as part of the sale such as a photograph or anything with a non-cash value? As long as the seller agrees that the value is unique, Disney can't match the object. The difficulty with that is getting the seller to go along with it and down the road, Disney might find some loophole. What would the seller's incentive to go along with it be?

Now THAT is slick! I like that idea!

Reminds me of something I recently learned about the Vatican. Now don't hold me to exact figures/facts, but this is kind of the jist of it. Apparently, the Vatican only has a net worth of about $900 Million. What?!? Well, all those "priceless" works of art they have sitting around? Worth? 1Euro each. Why? Well, they're "priceless" - meaning they're SO valuable/unique, they have no worth! St. Peter's Bascillica? 1Euro, as well.

I'd like to have my accountant sell THAT to the IRS!

ColoradoBelle1,

WOW!! More ROFR, how much can a person take?
I'm really sorry to hear that.

The reason I have not been on these boards until recently is two-fold.

1. I was knee deep in work at the office. I have tried to semi-retire, and it gives me a chance to catch up on things I've not been able to do in the past. We have a wonderful office manager, Jason, that I have complete confidence in. What a blessing!

2. I am what you might call computer illiterate, or computer challenged, whatever the correct phrase might be. It takes me a while to figure out how to do what I want to do, by the time I figure it out, the thread has died, or I forget what I wanted to say.

I have been so delighted with the people on these boards. I might not always agree with them, but that's what makes the world so interesting. The best thing that has happened is I feel like you people are essentially the pulse of DVC. The situations that mean the most to you, if they need to be changed, if they can be changed, how to change it! What I'm trying to say is I've learned far more from you all than I can ever hope to give back. But I will try!

Sincerely,
Tom

As a licensed Florida Real Estate Broker, it is against Florida law to pay a commission to anyone not licensed to sell Real Estate in Florida.

Per Florida statue 475.25h) "Has shared a commission with, or paid a fee or other compensation to, a person not properly licensed as a broker, broker associate, or sales associate under the laws of this state, for the referral of real estate business, clients, prospects, or customers, or for any one or more of the services set forth in s. 475.01(1)(a). For the purposes of this section, it is immaterial that the person to whom such payment or compensation is given made the referral or performed the service from within this state or elsewhere; however, a licensed broker of this state may pay a referral fee or share a real estate brokerage commission with a broker licensed or registered under the laws of a foreign state so long as the foreign broker does not violate any law of this state."

Hope this helps

OK, so how does this fit in with Disney paying a referral fee to anyone reccomending DVC? I thought it had to do with the home state of the person making the referral....

So, either Disney is doing something illegal or Colorado Belle has the right to charge or pay someone a finder's fee based on the laws in their states.
