Car Lemon Laws???????

My sister has a 2002 Kia Sephia! It has 60k on it!

She has always brought the car to the KIA service center for all the servicing. This year the Service Center gave her a list of services the car would need to pass State inspection (PA). To the tune of $2,000.00.

Some of these items have & were already fixed or replaced by the same service center THIS YEAR. Yes she has all the receipts. They came with more ‘wacky’ reason as to why they didn’t check their records and how these mistakes were made, etc.

Finally after 4 weeks of bringing the car back & forth to the dealer…each time they found something “NEW” to report on. She gave up and brought the car to another Services Station, Midas!

The Midas Technician put the car on the lift, and noticed right away that the Sub Frame that holds the whole car together is rotted! He said this is a Manufacturers defect, and should have NEVER EVER passed State Inspection. Nor will it ever pass State Inspection. The Midas Tech said that the Manufacturer should replace the car.

BTW, all the other incidents that the Dealer found fault with, The Midas Tech says IS NO PROBLEM at all!

I went with her to the Kia Service center. The lifted the car and took many pictures of it.
The Dealership had to talk to a Rep, and get back to my sister. Well they did and said, since the Warranty ran out there is nothing they can do. In fact this piece is NON FIXABLE and NON Replacable.

Since the Dealership has done the State Inspection for the past 3 years, I assume they KNEW this problem was there. Yet They DID nothing!

I firmly believe that the State Inspection SHOULD NOT BE DONE by the SELLING DEALERSHIP.

Is this covered under the Lemon Laws???? I know this will probably need to get Lawyers involved, But any information regarding this is much appreciated.

I think the car is too old for a lemon law to come into play.
 
Check the glove compartment. I think in some states, a booklet about lemon laws is distributed at the time of sale. Hopefully it will point you in the right direction.

I've heard that sometimes recalls are made over defective parts and replaced for free but dealerships are not required to tell you about them unless speciffically asked. Sounds like your sister's dealership is shady anyway, but maybe she could google her car to get the scoop and some documentation off the www.
 
My best friend was in a horrible accident with her Kia. Same thing. The entire steering column rotted out and fell out of the car while she was driving it.

Be warned.....Kia is a pain to deal with and they LOVE to tie things up in litigation. Despite the fact that my best friend's car was completely shredded underneath, it's been almost FOUR YEARS and they are still filing random motions to dismiss the case. My best friend hasn't seen dime one from them and they have refused to even negotiate with her lawyer.
 
My brother has been trying to get his Kia minivan lemon law'd for about 6 months. He already went through everything on his side with his lawyer, now they are just waiting on the Kia side.

His minivan was about 2 weeks old when the transmission 'blew up' the first time, they are lucky they weren't involved in an accident when it happened, the van just completely stopped moving! What if they were on the highway? And my 1 month old niece was in the car.

They've had the same thing happen 3 times again. I tried to tell them they never should have bought a Kia... :confused3
