I am so mad. I spent the weekend looking at Mattresses and decided to order them from Sears.com. They had excellent prices with the holiday weekend & free shipping if you ordered over $399.. I ordered three new Mattresses and a box spring. Well I got an Email today from sears this is what it said.

Thank you for shopping at sears.com

Unfortunately, demand for the mattress that you ordered was so great; we do not have any more in stock. Consequently, we have cancelled your online order. Please feel free to order this item at a later date. We apologize for any inconvenience this may cause you. :confused3

I can't believe they can just cancel my order three days later. After all the other stores sales are over! All my Mattresses were in such great demand? The customer service rep said I can reorder different Mattresses and when I went on their site they still had the Mattresses I ordered listed as in stock. So buyer beware!

Thanks for listening! :teeth:

I've heard from several people that Sears is getting really good at cancelling online orders. I am so sorry this happened to you.

I've had two experiences with Sears that make your story not surprising. I love Sears and I shop there, but I haven't exactly found them to be on the up and up when it comes to things that aren't happening right in front of your face.

That stinks about the mattresses.

Sears is not doing too well this weekend. they had an error with pricing a TV and the same thing happened.

As far as the mattresses---umm, haven't they heard of a back order or rain check?

there's a thread on the budget board about the tv's someone has a filed a claim about them cancelling all the orders you might want to go check it out???? that's bad business....

There actually may be a reason for this that is beyond Sears control. A friend of mine works for a company that makes mattresses and 2 of the companies that provide the foam to his company are out of business. One went under and the other was in the path of one of the hurricanes. I guess the building was destroyed.

Anyway, here's a link.

Foam Shortage

This may be a case where the company is doing something expressly prohibited by their own terms and conditions. From sears.com:

"Once your order is submitted to us, we cannot change or cancel an order until your merchandise is received by you." [Emphasis added.]

They have some exculpatory clauses that they may try to use to refute this (such as "IF YOU ARE DISSATISFIED WITH THIS WEBSITE AND THE CONTENT THEREON, OR THE TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THIS WEBSITE.") However, they representation that they cannot cancel your order until you've received your merchandise is so explicit, that I don't any legitimacy in claiming otherwise.

Of course, you may be unhappy with the delivery date they give you for your order.

I wonder if they can cancel due to the loss of foam supply? I would kind of sympathize with that but then they should say that disruption from Katrina is the reason for the cancellation.

I have a hard time defending Sears though. I haven't liked them for many years.

NOTHING Sears does surprises me anymore - they are almost becoming synonymous with bad/fraudulant business practice....I stopped shopping there long ago after a go around over a return of damaged/poorly mad merchandise which took MONTHS of phone calls and run around to resolve - and numerous other reasons as well. Sears and Kmart - two places I avoid.

(It was really hard after they bought Lands End - because I use to love them, but it did not take long for the quality to go down hill as expected!)

You are misinterpereting this disclaimer. This text refers to your specific order, in that it can not be modified once placed and confirmed. Read the Terms/Conditions found at the bottom of any page on sears.com and you will find this:

Such errors, inaccuracies or omissions may relate to price or to product description or availability. Sears reserves the right to correct any error, inaccuracy or omission or to change or update the Content without prior notice to you. Further, Sears reserves the right to refuse or cancel any orders containing any error, inaccuracy or omission, whether or not the order has been submitted, confirmed and/or your credit card has been charged. If your credit card has been charged for the purchase and your order is canceled, Sears shall promptly issue a credit to your credit card. If you are otherwise unsatisfied with your purchase, you may return it to Sears. Please see our Return/Cancellation Policy.

In the case of the OP, if demand exceeded supply your order will be canceled. Perhaps it was a special buy and there was limited availablility.

Then they should so indicate on the website.

After the mattresses and tv's I will NEVER order from Sears on the web. They cannot be trusted to follow through on anything for whatever reason.

How can they NOT have software that counts the inventory in relation to the orders. They should not be permitted to oversell. If quantity is limited---that's what a disclaimer is for. A blanket statement just does not cover it.

If it indeed was Katrina related--they could have salvaged some respect by saying so. But no..."just your orders cancelled, thank you!"

Poor customer service. I hated working there (management trainee..ugh!!!) and I prefer to not shop there if I can help it.

I can tell you that the dept store I work for does not have software that tabulates orders automatically against availablility. Our web store is maintained manually in that respect.

I would have to agree that I will not be inclined to shop online with Sears based on the events of this past week. However, I made two purchases from them in the past year, one shipped and one picked up. Both were successful.

Maybe all the people that bought tv's (or tried to) also bought mattresses so they could lay in bed and watch their new tv sets.

Sorry to hear about your mattresses. Sears sucks lately

Well I just got home from work and I have this reply to my Email'

Thank you for contacting Sears regarding order number *****
We apologize for the inconvenience this has caused you. We have checked
on the availability of these items again and we show they are all
available. We apologize for the confusion. Please replace your order and
we will honor all of the sale prices.

So I know I shouldn't but I placed my order again. wish me luck. LOL

Tell me what happened with the TV's I missed that whole thing.,. :teeth:

Thanks for all your kind words. gina :earboy2:

Thanks for that -- I swear I did go looking for that part of the disclaimer, which I had a feeling was there, but I just didn't see it. You're correct -- despite the earlier part of the T&C, they can legitimately do what they did to the OP.

We're having a problem with Sears with a shed we ordered and paid for in the store. It came in to the Sears store last Wednesday but every time the delivery company goes to get it the employees tell them that they can't find it. The delivery man then gets a call from the store that they found it and when they go back they are told they can't find it. The delivery company has tried to pick it up four times with no success. VERY FRUSTRATING! We called the sales person we bought it from on Tuesday afternoon and he said the shed it right where it is supposed to be and he would speak to his manager and call us back in 45 minutes to an hour. Well, today is Thursday and we haven't heard a peep. We WILL be visiting the store this afternoon in person...grrr. Sears was once a great place to shop, what happened?!

Oh my gosh. If this was on a sitcom it would be unbeliveable! How do you misplace a shed? I hope they find it soon and the delivery company charges them for their lost time. Good luck. :wizard:
