Can someone explain this to me (divorce related)

A friend of mine is going through a divorce. She does not have a lawyer and is doing everything through the self-help law center at the court house.

The facts:

She initiated the divorce.
She and S2BXH do NOT get along
She has a child with her S2BXH
They agree about who should take care of the child
They agree on visitation
They have no shared assets or bills
On Thursday, friend got temp restraining order against S2BXH

S2BXH has now hired a lawyer.

Why? Why would he need to hire a lawyer?

I know nothing about divorce…nothing! However, I’m starting to wonder if there is something else going on with him...

Sounds like their amicable divorce is heading into the courts because it's not amicable anymore. So they both need lawyers.

After that, if there is a restraining order, of course there HAS to be a lawyer involved. That simple.

If she obtained a restraining order on her husband, and there is a child involved. Of course he got a lawyer. It is clear she is about to try to obtain sole custody of the child. If he didn't get one, hes an idiot. She is going to need one asap.

They do not get along so hiring a lawyer is using common sense imo.

I know this will sound stupid but, why does he need a lawyer if there is a restraining order against him? Isn't a restraining order just to make sure they stay apart from one another. :confused3
 
When she got the restraining order the whole game changed. Lawyer time and now the cost of this divorce is going to go up as well. If she needed a restraining order then there are probably other things going on that you might not know about.

Actually, they agree on who gets custody and it's neither one of them. :headache:

then there is a lot more to it than you posted here. But if she went to court and got a restraining order (order of protection), she has declared that she is a victim of her husband. The purpose of the order is to protect her from him.
It is not used lightly and it does not just mean stay away from each other. I feel he does really need a lawyer.

I think it's the OP who doesn't know understand why he got a lawyer. I guess I'm not sure about the wife.

I think it came as a surprise because this divorce was started a while ago and he only now got a lawyer. Plus, the way he said it kind of freaked her out.
 
Of course he should get a lawyer. This is a legal situation. He only now got a lawyer probably because she only now filed a restraining order.

Sure, but when it gets to the point where you need a court and police reinforcements to ensure that they stay apart, then they need lawyers to explain to them the legal consequences of actions that might seem perfectly innocent (like phoning the S2BX), to advise them what the other party might initiate next in terms of legal action and how to best protect their own interests, and to deal with the legal stuff related to the restraining order.
 
Maybe he has changed his mind and now wants custody. Best to get a lawyer when there is a restraining order against you.

I gave the basics, but yes their marriage was filled with some problems. She was not the victim of physical abuse, so this isn't one of those situations. She is however, being harassed and emotionally abused by him on a daily basis. She was also being stalked by him. :headache: She got the RO at the suggestion of a court advocate. She was not however told what to expect.

Yes! Though, I don't think she does either. This divorce has left her slightly brain-dead.:sad2:

He only just got the lawyer because she just got the restraining order. If she didn't want lawyers involved she shouldn't have got the police involved.

restraining order=lawyer, at least it does if you are smart and can afford one.
 
Luckily I have never been through a divorce, but it's really not a do-it-yourself-with some-advice kind of thing especially with children.

She needs her own lawyer and so does he. Why the wife is perplexed that he got a lawyer after she filed a RO is just strange to me.
