Hi All,
My cousin, has not yet decided what to do with her BWV points. Her son is much older and they go to WDW less often. Is it possible for her to permanently give me her points/membership? Would it be a simple transaction of name change? I am also a DVC member. how does Disney respond to something like this?
Thanks!!!

It's not just a simple change of name.

Since the contract is for a deeded interest in a lease, your cousin would still have to get the deed changed. She can do that herself or hire a "closing company" to do it for her. She has to get a ROFR waiver from Disney, but they are reported to be fairly easy to deal with in these situations.

It would be a real estate transfer so you would need to have her transfer via deed and get it recorded and pay any fees related to doing that (usually not much). Disney does not actually have a right of first refusal as to a gift. However, you still need to go through the same process and have DVD waive ROFR (it does have a right to verify it is a gift and not a sale), which it will do as long as it is a gift.

If it's a gift, it is a deed change but in this instance it can be done fairly easily. getting a ROFR and a quit claim deed is not difficult, total cost can be under $40 for a single contract. If there is ANY money to change hands, it is somewhat more complicated but still workable in the same manner. The only issue is that if one then goes to resell, they may not be able to get title insurance due to the quit claim deed. One can still do a warranty deed in this manner, just a bit more complicated. We just added my daughter to 4 contracts in the same manner.

Thanks Dean,
I'm going out on the internet now to look up quit claim deed and warrenty deed. you sound very weel vesres in this, where I am not!

Email me privately and I can send you a template I found for a FL quit claim deed and the documents that DVC sent as well as the document from the state you have to do.

My ex and I are working out our property split for an amicable divorce. He gets to keep the "expensive" car, I get the DVC. :rolleyes1

I live in California. Does anyone have a copy of the quitclaim deed I need to use for Florida?

Maybe someone can confirm, but I believe you can only do a quit claim deed if the contract is paid off in full. I don't think you can do this if financing is involved.

Email me and I'll give you what I have including a Word Template and instructions from a law firm I found. I can't vouch for it other than to say I used it without problem.

Well I am 4 posts short of the required 15 to send you a message - so I'll post on a few forums tonight and then PM you!
