I bought something from Facebook on a consignment page. It's about 2 sizes too small and the seller measured it wrong. It's 6" shorter than she said it was. It also has damage on it that she said she didn't notice before shipping. I told her I would ship it back and I would like a full refund. She said she wanted pics of the damage. I showed her. She ignored me after that. I filed a dispute with paypal. She has responded (no idea what she said, they don't tell me that). Is there a way to send the pictures to paypal along with our conversations w/ her stating the measurements? Will they automatically dismiss it because it wasn't sold through ebay? I'm really mad over this because it was not a cheap item and is useless to me now.

just escalate the claim and the next step will be for you to ship the item back. Be sure to use delivery confirmation and possibly signature confirmation and insurance if it's a high valued item - once it's been confirmed returned paypal will refund your original payment. You do have to pay for the return shipping costs. -

Just reread that it wasn't on ebay - different rules then - best bet is to call paypal and speak to them on how to proceed. I once bought an item through ecrater and paypal wouldn't settle since it wasn't ebay - good luck!

Should the claim be denied by Paypal you have have three options:
1. If it was pretty expensive you can take her to small claims court.
2. If it is not expensive enough to make doing that worthwhile, then take the hit as a lesson learned about buying from unreliable sources.
3. Sell the item to some other schmuck and in the ad put in really tiny print "all sales are final". That way you get your money and the person can't return it.

FYI it doesn't matter if you put all sales are final, paypal will still give the buyer their money back if there is an issue on ebay.

I've read a ton of feedback regarding this on other sites. Most say it doesn't matter where you bought the item (facebook, craigs list, a friend, etc.), paypal has a protection policy for everyone regardless of origin. But a few others said they bought items from reputable stores that take paypal (think TRU, etc.) and filed a claim and were immediately denied so who knows.

I CAN resell the item...the fact that it is 6" too small because the idiot doesn't know how to measure or size and item would work for someone else in a smaller size. The other issues are ultimately fixable...just not something I'm interested in fixing for an item that unusable due to her errors.

Sooo if my claim is denied, I plan to just dispute it with my credit card company directly which seems to have success based on what I've been reading...and they would still debit her account for it in the end.

I was going to suggest taking it to your cc company if paypal didn't help. :) I had something that I bought on eBay and never received, but the seller had tracking so Paypal totally dismissed my claim. I contacted my cc company, told them I never received the item and had the money refunded within 2 days! I always try to resolve any issues with Paypal directly but if they don't help then I can go to my cc company. :)
