If my van doesn't get repaired at somebody else's expense, I will be doing some major complaining! But you know, that's all I really want... my van repaired.. nothing more. Just wanna be done with it. And no, I don't think she knew him. He was from South Carolina. And I highly doubt he was in law enforcement himself... he was a cocky little SOB... ;)

Did you take digital pictures of the accident scene and the guy or were you too shook up? Did you get ANYTHING in writing from Miss Cletus?

They should be able to mail you the incident report, at the very least. Once they've figured out the whole mail system, that is ( can you tell I'm not a big fan of the southern part of Georgia!)

Hope your van gets fixed, what a bummer about it being new, but I'm glad you're all ok.

I did take pictures of his vehicle and mine, with my cell phone. My daughter did also, as hers takes better pictures. After the other driver saw me doing that, he did the same. Camden County, Georgia... think that's what it was called... of course when I called 911, I had NO clue where I was, only that I was in Georgia and on 95...
 
Welcome to Georgia. For some reason they hate people that dont have Georgia plates. I drive down to Disney from New York everytime I go because the DGF is afraid of heights, and probably 75% of the time they pull me over on a busy highway and hassle me for 20 mins before letting me go. They just dont care about people with different plates, that is my opinion anyways because the 5-6 cops down there have made specific refrences to New York when I was pulled over.

Just curious, but did you drive straight through? Given the time you were in Georgia when the accident happened, I thought maybe you were?

Really? Didn't know anybody knew where this teeny town is! Where are you??

We DID drive straight through- or tried to, anyhow, lol. On the way down, we left Friday night, at 7pm, and we stopped to eat/gas up a couple times, and stopped at South of the Border, for a quick look, and then after dealing with the accident, we made it to our vacation home by noon the next day. On the way back, we left Florida at 10am, stopped a couple times to eat, another longer stop at South of the Border (fireworks for the hubby and boys), and made it home by midnight.

It looks like you're going to have to go through the rental car agency's insurance, not the offender's. They're not going to make it easy for you, so hold onto those pictures. Expect them to make things difficult every step of the way, but don't give in and use your insurance-you weren't at fault!!!
 
I also hope Georgia isn't a "not at fault" state. Basically what I know of that is that if it is a NAF state then both parties are deemed at fault so to speak and each driver's insurance fixes their respective vehicles.

The only reason that I can see for the officer to not take your statement was that she thought it was your fault. This happened to me one time when I entered an intersection and was almost through when a van that was going over the speed limit hit me in the right rear quarter panel of my truck. The impact was strong enough to spin my truck completely around yet because I had a yield sign the officer deemed it my fault automatically and wouldn't talk to me.

It didn't matter that I couldn't see the guy coming over a hill and that I had plenty of time to cross if he hadn't been speeding...It was the way the law was written. That it's automatically your fault if you have a yield sign.

From my experiences, you will have to get a copy of the report to your insurance company. Then you'll need to get an estimate. Listen to the advice given on here about that. If you know a body shop person, then use them because if they have a bit of experience then they should know little "tricks" to help you out as much as they can legally. Then if the two insurance companies agree on a settlement then you'll get a check to repair your vehicle. If they don't agree then you'll likely go to court.
