My dad ordered an item off ebay at the end of March on by behalf. We paid 'buy it now' and emails were responded to etc. She said the item had been dispatched and would take possibly up to 10 days...well guess what...still nothing! Thing is we have since found out the item is being sent from a place abroad, althought the seller herself is from the UK, she keeps saying give it a few days etc...but to be honest i just want my money back now! Do we have the right to ask for the money? We paid via paypal and are covered etc but i just want the money and go buy it elsewhere. The seller has responded to emails etc
 
does the seller have a lot of feedback? if not you may have been scammed.

you can contact both ebay and paypal to try to resolve but in my experience they don't do much... hope your item arrives
 
She has positive feedback and other items recently have been sent and recieved and people have left her feedback for those. I do think it has geniuly been sent and not recieved, but it seems to be taking ages!

Go to My Ebay Summary page and select "Report an Item Not Received" from the drop down list next to the item. This basically starts a tracable email contact with the supplier and informs them that you haven't received the item. The supplier can then respond, usually if the seller is legitimate they will resolve the issue, if you don't get any joy after a set period Paypal should try and get you a refund.
 
If the seller has no proof that the item was sent you should also be able to recieve a refund if you go via paypal.

I can agree with this.
We bought an xbox from a brand new ebay seller and because it ended early in the morning we were the only bidder and we got it really cheap.
It was cash on collection so I emailed him to arrange a convenient time, he didn't respond to my emails for over two weeks. I noticed that his feedback was -1 it was apparent somebody else had had the same experience and left negative feedback. I did the same and he emailed me the next day and we eventually picked up our xbox today!

Try seeing if she is willing to mutually withdraw the winning bid. That way she will get her fees back & you can get your money back.

If the seller has no proof that the item was sent you should also be able to recieve a refund if you go via paypal.

It's actually more favourable to the buyer than that - if you pay via Paypal, the seller actually has to provide a tracking number. Proof of postage (eg item sent by normal first class) is not sufficient, and Paypal will refund the buyer if this is all the seller has.

You can open a Paypal dispute (rather than Ebay) for this situation - if you escalate the claim, the seller only has a limited amount of time to prove delivery before Paypal will find in your favour.
 
Well shes asked for another week, and if it were my ebay account i'd brought it off i would be putting in a dispute, but since it's my dads he wants to wait till wednesday! Thanks for all your advice
 
From the seller's point of view (having sold a lot on eBay myself) I can see why she wants to hold on a bit, though items getting lost and the buyer claiming their funds back through Paypal is a risk you take when selling and really she should have had it sent by a trackable delivery method to cover herself especially if it was worth a fair amount. You have 45 days from the payment date to file a dispute by the way so your dad will be safe to wait til Wednesday.

Hope things get sorted. Sometimes the postal system can be to blame. I know I had to send something across to Ireland once because someone had kindly ignored by statement that I only post to the UK and bidded. The surface mail to Ireland was quoted as taking up to SIX weeks, can you believe it? Anyway as it turned out only took 2 weeks but that is one of the reasons why I don't post abroad, more chances of it going lost or taking too long.
