The first thing that popped into my mind was that it was a drink for an employee. I spent 15 years in the restaurant business, 5 as a manager, and have seen this happen quite abit. It hides the "adult" drink from the sight of managers and guests. Some managers will require off duty employees to have their after shift drink put in one of them so that patrons will not see what exactly they are drinking. Servers also will drink their sodas out of the kiddie cups so that they can write their name on it and use the same one for the evening. I think that the bartender made the LT for an employee, either on duty or off, and it got accidentally picked up and served to the child.
 
The Mom was on Fox news yesterday(or maybe it was Monday) anyway, she said that she immediately called the ambulance and went to the hospital. She said her kid is having post traumatic stress disorder from the whole thing and is seeing a counselor in order to "cope" with this situation. Um, ok, a child that age wouldn't have any clue that they could DIE unless the mom made him aware of the situation. If this had happened to me, yes, I would have been very distraught, but suing? Nope, never. Oh, and the mom was also quite peeved because she was given the bill and had to pay for it. Wonder if the drink was on the house?

From what he told us and the summation of the case that we read, It was proven McDonalds maintained the coffee at a higher temperature so that the coffee would keep its flavor longer while it was in the pot waiting to be served (it saved MickeyD's money in the long run).

While I feel Mickey D’s was in the wrong for brewing such hot coffee, I don't believe for one second that the woman pulled over on the side of the road to drink her coffee. No one will ever convince me that she wasn't drinking (coffee) and driving at the same time and accidentally dropped it on her lap upon taste of the hot coffee as it probably burned her tongue.

Well, that is your opinion and if you had been on the jury you could have determined that as a fact.
 
I remember when I was a teen, we went out to a restaurant. I ordered a 7-Up but they bought me a Seagrams 7 & 7. (I think that's what it's called, not sure though.) My dad tasted it and called the waiter over to have it sent back!

Well that clinches it for me right there. Made up story. Unfortunately, she probably will get some money out of it. Very sad. I hope she at least puts the money in a college fund for her child.
 
Post traumatic stress disorder?!!! Oh please.

It looks like someone has their grubby little hand out for money in this case.

That's the same thing I was thinking.....post tramautic stress disorder - for two sips of a LIIT? WOW!!

I 2nd this - thats the first thing I thought too.

When I bartended and served, we put our drinks in the kiddie-cups too.
 
That kid must be pretty traumatized from those 2 sips!

I think the companies should invest in styrofoam cups to prevent any further confusion. This would be negligence then if it was the policy to serve drinks this way. B/c then it opens the door for incidents such as this.

How a 5yo will suffer PSD from this, I'll never know. Unless mom made such a big deal about the ER visit (or the kid just doesn't like docs and REALLY didn't like his trip to the ER).
 
The mom said the child was treated for dehydration...
and that he is not able to sleep at night and won't drink anything unless he is sure it's something okay. The mom must have really caused quite a scene at the restaurant for the kid to be affected in this way.
