If it's a matter of incentives, I would think that DVC could correct that without it impacting your closing. I would definitely push that one, even though you're sort of at their mercy.I probably shouldn't really go into the details, but suffice to say that DVC acknowledged that they messed up and shouldn't have closed the loan. The real impact is that we can't take advantage of the newly released incentives because the loan was closed in error. Just wondering if anyone else has had a similar situation so I can know what to expect. Waiting is so difficult.
I assume they made a mistake in the deed or number so similar. If so, all they'll likely do is to correct the paperwork and/or deed and refile the papers. I'd doubt it'd let you out of the deal or allow you to change to new incentives. However, it would depend on specifics. Ultimately it comes down to whether you could cancel or not due to the mixup. If so, you can likely get your choice of old or new. If not, you won't be able to get the new incentives.I probably shouldn't really go into the details, but suffice to say that DVC acknowledged that they messed up and shouldn't have closed the loan. I was wondering if anyone has ever had to void their contract and re-close due to an error on the part of DVC? If so, please share your experience. Thank you so much.![]()
It's certainly your call whether to share the details but I don't think we can offer anything further without them. As noted, if it was truly their mistake rather than a misunderstanding, they will find a way to fix it.Thanks for the replies, everyone. It sounds as if I'm kind of in a unique situation here (which I guess means that Disney doesn't mess up very often - LOL). Last I heard, our paperwork was somewhere in the bowels of DVC management waiting on approval/instructions on how to handle. The details are immaterial but, thankfully, DVC has acknowledged that the mistake was theirs and that our loan shouldn't have been closed. Regardless, if anyone has had a similar experience in voiding a closing, I would still be very interested in reading about it. Thank you so much!

Yeah, I hope so - - everyone at DVC that I've spoken to up to now (my Guide, DVC Compliance) has confirmed that the loan should not have closed and, therefore, we should have been easily able to amend our contract to take advantage of the new incentives. I have been promised a response today so I will come back and post the whole story with any resolution when I receive word. And, thanks again to everyone for your words of encourgement.![]()
I don't know but for some reason I'm getting the impression that it wasn't so much a mistake but a variation from usual procedure. If that's the case, and it's been filed, they may not allow you to reverse it. The only way to force it would be if they didn't deliver what was promised or they closed prior to the 10 day right of cancelation rule.Yeah, I hope so - - everyone at DVC that I've spoken to up to now (my Guide, DVC Compliance) has confirmed that the loan should not have closed and, therefore, we should have been easily able to amend our contract to take advantage of the new incentives. That's the sense I'm getting, as well.
If this is a situation where DVC did not wait the mandatory 10 days, then an error was made. But if they 10 day cancellation period passed and the contract simply closed earlier than expected, that's not something I would classify as an error.
True, true. I was thinking that maybe the OP had actually talked to her guide/DVC and been assured that the contract was not closed and would be "held" from closing in order to apply the new incentives. Then perhaps the closing happened anyway, for whatever reason. Although DVC of course wouldn't be required to fix the situation, it seems like they might if they had verbally assured her that she could use the new incentives, if only from a customer satisfaction viewpoint.
You guys are making me laugh about your speculations, especially given that you don't even know our situation...
