My SIL received her child tax credit check back in July. But her husband (they are separated) refuses to sign the check - his attorney has advised him to but he refuses. She has full custody of the children. Can she return the check to the IRS and then will she get the money back when she files her taxes next April. He is only going to be paying child support for the months of Oct., Nov. and December. There are two children. A domestic violence order gives her full custody for one year.
 
YIKES! What an unfortunate situation for your situation. I'm not an accountant. I hope someone can answer your question.
 
Since she was issued a check, she won't be able to get the credit on her taxes next year. They track this based on SS# and I don't think you can "send it back" due to a domestic dispute. I'm guessing that your SIL and her soon to be ex filed a joint return last year. In that case, she does need his signature to get the check cashed, unforunately. I'm sorry I don't have better news.
 
thanks. I was hoping she could send it back and they could reapply it to their ss #s and then next year they could file their taxes separate.
 

I work in a bank and we accept checks for deposit only with "For Deposit Only" written on the back. It's very common. Have her try that - she won't be able to get the cash right then and there, but just give it a few days for the check to clear and she should be all set.
