An ebay dispute question

I won an auction on 3/14 from a seller in England. I paid the same day via paypal. I have since sent 3 emails asking when it was shipped etc. No reply. What should I do? Do I contact my cc company to dispute or paypal directly. I just notice too, that the seller is no longer a registered member? Am I just screwed on this or do I have recourse.

Contact PayPal. They will go after the seller and do the investigation.

I had a problem like this last summer. The seller lied and told PayPal that he had sent it out but when I received it it was postmarked for the day PayPal confronted him! :rolleyes:
 
I think you only have 30 days to initiate the complaint with Paypal too, so you need to start that today!
 
OK of course I just get an emal saying it was shipped 3 weeks ago, and she checked with the postal service and was told that an investigation cannot be initiated until 30 days. If I wait then I will stuck. Should I dispute it waitng for her investigation? She has no neg feedbacks from buyers but she has 10 recent negs from sellers i.e. non payment, dlelayed payment etc. What to do?
 

I would still file the complaint. I had a similar situation happen to me once on an item. The seller had well over 1000 feedbacks with about a 98% positive. I paid with paypal immediately after the auction. After about 2 weeks I emailed about when the item would be shipped. The seller didn't respond until after my 3rd email and then she said it was shipped the day after the auction and to wait two more weeks and see if it arrived because she had had other items in the past that were misplaced by the post office and suddenly found. she also said that if the item didn't arrive in two weeks she'd give me a refund. Well two weeks came and went and still no item. I emailed her back about the refund multiple time and she never refunded my money or responded to my emails. I was fairly new to ebay at the time and I think she knew that if she could convice me to wait another two weeks I'd be past the complaint filing period and she would no longer be responsible. I lost about $20 on that deal. I had a friend lose about $5k on a stupid item he never should have purchased on ebay to begin with.

So file the complaint!! You can always drop it IF the item arrives.

As a high volume seller/buyer on ebay, I would recommend that you contact paypal and file a claim with them (buyer protection). Simply stated you paid for an item, and the seller comitted fraud by not sending it to you. Judging by the high volume of recent negs the seller has, the chances of you actually receiving the item (or getting a refund from them) are very slim. Contact paypal asap.
 
Ok thank you all. I went and filed a complaint with paypal. Now one more question. It says they do not guarantee recovery of funds. Does that mean I will not get my money back?

If the seller can prove that it's been shipped, then you probably won't get your money back. If they shipped it and you didn't have insurance on it, then it's really out of the seller's hands once the post office gets it. As a seller, they've done their part by packaging it and taking it to the post office for delivery.
 
One more question than I will leave you alone;) Does the seller have to have proof of mailing in order to dispute the claim? Or can she just say it was mailed so its out of her hands?

Good question. I have no idea of the answer. I put a packing slip in everything I sell. I also make a copy of that packing slip and staple the shipping document to it so I've got a record. And I just sell stuff around the house. I would think that a high volume seller would have a similar system in place.
 
You have to have proof of shipping. Along the lines of Delivery Confirmation.
 
They must have proof of shipment via an online trackable number. That means it has to be shipped via USPS with delivery conf, fed-ex or UPS. If it cannot be tracked online, then paypal will rule in the buyers favor.
 
I don't know about UK to US shipping time. However, I've shipped many larger items by sea from CA to AU and it takes about 5 weeks. Via air takes about 3 weeks.

Now, considering any overseas package entering US will be checked, you need to add another week just for it to go through custom.

Again, from my personal experience, US to CA via air is 5 business days max, but CA to US is 15 business days max due to the wait custom clearance
