Advice needed... Sell DVC during divorce?

The idea of keeping the smaller contract and buying him out has merit. I'm not sure if you are focused on just one resort as your home but resale points can be purchased for a song at OKW and other resorts. If you check the points charts you'll find that if you are willing to studio it you can go every other hear and get a five night at a studio in OKW for as little as 55 points.

I hate to hear of someone going through what you are. I know a lot of couples where one or the other is a Disney-o-phile and the other is blase about it.

Personally I need my Disney fixes for R&R

I am resort loyal. I LOVE AKV!!!! Like, I seriously love it. OKW was okay when we stayed there this past summer for a little, but it's not my AKV. AKV really feels like a second home.

Well, it feels weird to rehash my own ancient thread here - I hope I won't get in trouble with the moderators. (Just let me know if I'm breaking any rules, mods!) But I needed a little more advice on how to handle the next step of this situation...

The divorce finally became official this past year, after a looooong three and a half year process of my ex dragging it out for the sheer purpose of making life miserable.

Long story short, I got the full DVC as part of our official divorce settlement. I've decided to keep it.

Now I'm actually looking into getting his name removed from the contract. (I'm getting remarried and would ideally like to add my new husband if possible.) Future DH has grown to love Disney as well, and I'm still a Disney specialist for a travel agency, so my Disney expenses are all tax write-offs. I keep up with my dues and we've been going to Disney annually. (And want to continue to do so.) I freakin love Disney!!!!

But the first few searches I did here on this topic are showing that it's a bit complicated and costs a chunk of money? Plus, some of the threads I saw were a couple years old. Are there any new places or businesses that handle this cheaply and easily?

I'm overseas most of the year, as my fiance is not American. (He's Croatian, so we live in Europe most of the year.) The rest of the time, I'm still in PA. I'm hoping this won't be a problem....

Any help or advice would be greatly appreciated. Thanks so much!

May I ask something? What is the benefit of adding him to your contract? I'm not wishing you any ill will, but it seems like it might be best just to leave him off so that you don't have to go through the whole "who gets the DVC" thing again someday. (Hopefully not of course). Is there any true benefit?

You can do it yourself for under $50. LT transfers is the cheapest I know of to get someone else to do so, under $200 total. My suggestion is to do it yourself in this situation, of course there has to be no mortgage to change it. If it were me, I'd go ahead and contact DVC ASAP and have them email you the forms packets. Get that moving and go ahead and get a quit claim deed prepared. Get the Ex to sign it now, ASAP. Then when you get the paperwork back from DVC for the ROFR, be ready to send it all in to OC. In that package should be a final transfer form, get him to sign it as soon as you get it so you'll be ready to send it all back in once the deed is recorded. Once you get to that point be watching the OC website and as soon as it's recorded, print it offline and send everything back to DVC. Don't wait for the deed to come in the mail. Ideally this would have been done within the divorce.

Unfortunately, since the divorce took so many years, I think both lawyers were fed up with the whole situation and wanted to get things finished as quickly as possible once my ex came out of "hiding." (Yea, he would frequently go MIA for months at a time from everyone and everything.) At that point, it was costing lots of extra money to get ANYthing done. I think as a result, the lawyers didn't bring anything additional up - they just wanted him to sign everything while he was in the mindset to do so. (To try to do it in case he disappeared again for months...) And me, not being a legal expert, foolishly thought this could just eventually be settled with a notary or something like that.... sigh.... Okay - so it seems I'll be able to get this done when I'm back in the States? Seems like it might be too tricky from over here in Europe, with all these back and forth papers and such...

I'd agree. Being on the short end of a bitter divorce where things were drawn out by the other side to try and increase costs, I'd make arrangements for a notary close to his location to help out and if you can reach him, say if he does not want to incur any further legal expense, hassle or damage to his credit rating, to get himself to this notary by a predetermined date to sign the required paperwork to transfer DVC to yourself per the divorce settlement. IMHO I'd keep title in your name alone since you have the write-off and given all works out, you will have many years of continued enjoyment of DVC with your new partner.
