Above ground install problem

So we ordered an above ground pool. they did not have what we wanted but did have a floor model. We were asurred it was subjext to all the same waranties if it had been in the box. So far we are out 7200.00.
Pool is bought October 18th with the deal it would be up ready, and closed for the season in 48 hours.

It is not up. it is in peices sitting in the mud in my yard, pieces are loose and rolling around. Installer bent components. he was given an 800 deposit. Has canceled 2 dozen times always at the last minute.

I began to get suspicous and got intouch with a woman suing this installer for Horrible work!!!!
legally I would be a fool to allow him to continue to work. AFTER I became aware of complaints.

heres the issue the retailer although he was referred by them as an "Expert" is refusinfg to give us any remedy other than getting him to continue the work.beyond the BBB attorney general and Court. anyone have any ideas or advice?

Can ya return the pool and cut your losses?
 
I would contact the BBB and tell them the whole story. Maybe a letter from them to your retailer will change his mind. It's worth a shot. Losing $7,200 is not something I would just let go.

Geeez, what a mess.

You might seek some legal advice as another installer may not want to jump in and actually do the job for you since it's gonna get sticky with possible missing or broken parts. You should consider consulting the attorney who filed suit for that woman who tipped you about the installer.

I'm so sorry to hear your pool paradise turned into a mess, good luck, keep us posted, especially if you need to vent. :hug:

I'd call the store that sold you the pool again. They gave you the name of their installer..you contacted him and paid a deposit in good faith based on the stores recommendation. Talk to the manager and let them know you will be contacting the local news and papers (do they have consumer action people?) and also contacting a lawyer. See if they will be willing to strike a deal to take the pool back and if not than follow through.
 
I am intouch with the district manager who's position, Is I sold you the pool I merely suggessted names. So it's your problem.

He is not willing to do anything other than call instalelr 1 and get him on the job site. Ahhh no thanks. Said call the attorney general whatever, not his problem it's mine.

I went from a price of 1900,Quoted by sales staff. (for install.) To 2400 when the guy showed up. I gave him a 800 dollar deposit. We budgeted 8 grand and now are well over 10 grand.

Now I am out the 800 plus 2500 to the new installer who can not do it this year as its to cold to set the liner.

So somthing that was quoted 1900 is now 3,300. plus I need new stone dust at 260.00 Big difference between 1900 and 3560.00. I am beyond annoyed.

I have posted 3 complaints naming names on consumer websites, contacted teh attorney general. and the better business bureau in my area. it still doesn't change the fact it is sitting in pieces in my yard!
