DH and I have pretty much decided to buy DVC though we are a few years away from pulling the trigger and I am trying to do as much research as possible in the mean time to make sure we make a wise purchase that fits our family best.

I have two questions that I am pretty sure are stupid questions but I want to be sure I know the answers.

Say I find a resale contract that is loaded. After an offer has been accepted or whatnot if I want to make a reservation for less than 11 months out could I arrange for the owner to make a reservation in our name before the sale closes or would we have to wait until closing?

The second question is about use year. Say I have an August UY. I am out of points for 2016 points and will get 200 points in August 2017. I can book a trip any time so long as I will have the points in my account before we travel right? Meaning I don't have to wait until August when I get the points in my account to book a trip in January 2018 I could go ahead and book that now is that right?

No, you'd need to wait to book until after closing. All open reservations are cancelled when the contract is transferred.

You don't "get" the points. They're always there. Use year determines which points can be used. Use year has no bearing whatsoever on when you can book.

Hopefully someone with experience with this circumstance will chime in. In the meantime, I will take a shot at it.

1) No. Disney application for ROFR waiver requires that scheduled DVC stays be completed. They also like all member dues be fully paid prior to sell.

2) This one touches on the first (and hopefully last) error I made in making a DVC reservation. Points for stays are taken from the UY in which the stay occurs. For example, on Sept. 1, 2017 you make a reservation for Aug. 1, 2018. The points will come from the 2018 point allotment and NOT the 2017 allotment (unless you bank 2017 points). [That sounds confusing to me and I typed it.]
 

While the previous owner cannot book a vacation for you before closing, you can request that the previous owner bank points into the next year for you before closing if you risk missing the banking window when closing takes longer than expected.
 
You do not "get" points. UY gets over complicated by people all the time, it is not a stupid question.

Say you have an August UY, and you are making a reservation starting January 18 of 2018.

Simply ask "what UY is the reservation I want to make?"
In the above example, the desired reservation is in your 2017 UY,

Next ask when does my 11 month window open?
The answer to that is February 18th, 2017. That is the first day you can make that reservation. Since you can make that reservation, you can borrow your 2018 points to do so. You do not have to wait.

Personally, I do not like to think of it as "getting my points", but if that thought process works for you, the answer would be you "get" your points for a specific UY 1 year and 11 months before the start of that UY. That is because with an August UY, the first date of that UY is August first. For August 1, 2018, the first day you can make that reservation is Sept 1, 2017. That is the first day you could use 2019 points)
 
We have a related question. We own DVC in my and my wife's names. We've set up a family trust and want to transfer the ownership into that trust. We also have a reservation made for this coming November. A previous poster noted that when a contract is transferred all of the reservations on that contract are canceled. Does anyone have experience with transferring a contract to a family trust, meaning it doesn't really change the person who owns it? Are the reservations canceled?
 
The exception on existing reservations is for family transfers/name changes. Besides banking, you could also travel on those points BEFORE closing in some cases even if one had to delay closing to do so.

Seriously? But in the letter we got with the ROFR paperwork, with a spouse name addition, it clearly said that reservations needed to be completed first. Ugh. That's one of the two reasons we didn't move forward. Shoulda called them...
