I'm sorry for her. Atleast she will be able to collect unemployment for a while. Its terrible that she had to get a letter like that, it seems so cold.

Just wanted to say I´m sorry she has to go through this. Seems her workplace was in the wrong. Hope everything turns out well for her. You know what they say about "when one door closes...". ;)
 
C.Ann, what they did to your daughter is terrible. Apparently they don't realize how lucky they are to have someone willing to work with these girls. I hope everything works out for her.
 
So..........she just called the head of the institution and left a message for him indicating that she is "interested in applying for the manager's position on xxxxxx unit.." - the job they just terminated her from..

That makes your daughter look awesome - to still want to do the role and to be prepared to reapply for it. They'd be idiots not to (continue to) employ her.

His job was 'under new management' so to speak and their visions didn't really line up. We knew a change would be made. It is sooner than I thought they would do it though. I figured since a high profile job in his field just came open which they are having trouble fillling that they would wait a little while longer.

I'm only angry because he had another offer this past Nov and the new managers asked him to stay...only to fire him 4 months later.

Hopefully this will be a blessing in disguise for both your daughter and my family.
 
Don't ask me why she wants to stay there.. She just has this need to help those kids - even though they can be extremely abusive - and at times, downright dangerous - but it's her life and her choice, so I'll support her in whatever she decides..

With that personality I'm willing to be there are many workplaces that could use and would want a lady like her! Good luck to her and wishing her the best in her healing.

As said before - when one door shuts, another opens.
Help her create a great resume with all her skills down, as well as a new feel for herself (shoes, makeup etc) so she can stand proud and she'll do great!
 
Why didn't any of her Dr's put her out on medical disability while they were trying to figure out what was wrong? I think when you are out on medical leave, you can't be fired.

When my father was 63 1/2, he had a stroke. He worked over 30 years with the same company. While he was still in the hospital just a few days after the stroke, they included him in a small layoff and notified him by letter. In all the years of these small layoffs, his time and dedication always protected him. It was heartbreaking that they chose to do this when he was ill. They worded the letter in such a way that he would be on leave during the FMLA period and then his layoff would be effective on the date the leave ended or he was deemed ready to return to work.

I also worked for a company that terminated people who were frequently ill, and not just faking it. Though I am certainly not an expert in this area, I don't think it is illegal to terminate these people, even if it may seem immoral on the surface. In the cases I saw, it wasn't considered termination with cause so those workers were able to collect unemployment.

I wish everyone well who faces these circumstances.
 
DD received a letter in the mail today from her employer notifying her that she has been terminated - effective the same day she had her surgery.. (That was also the same day that her Family Medical Leave Act ran out, but there was no way they could schedule her surgery sooner..)

Now the question is - was her health insurance still in effect that day or not?

This is not good - not good at all.. She's in tears - 13 years down the drain.. The most I could offer her in terms of comfort is that she'll probably be able to qualify for unemployment considering the surgeon has released her to return to work on Monday..

Her DH will have to pick up health insurance from his employer now - which I believe is quite a bit more than what she was paying..

Maybe this is a good thing.. Maybe it was time she got out of that place.. But for now, she's very, very upset.. :(
She won't be able to collect until she gets her release. She needed to be available and able to work on the Sunday of the week she became unemployed to be eligible.

Believe me, with a situation like this you are better off to move on. Often times you end up in a better position.
