13 Year old gir declared brain dead has now officially died

Well I'm sure the hospital staff is relieved that this is finally coming to an end. I feel bad for the mom. Eventually the girl's heart will give out and the family will have to face what they've been trying so hard to avoid. Such a tragic situation all around.

But is it really coming to an end? This all still supposes that they have somewhere to take her, and medical professionals to take care of her from the time they take possession of her until whenever. And now they have 4 days to do that. The TRO expires on the 7th so if they haven't been able to remove her from the hospital they then have to go and try to get another TRO and the hospital has to keep caring for the child and fighting them in court.

This agreement seems like just a stalemate. Hospital says Fine. You can do what you want with her to keep her "alive" but we still won't let anyone perform the procedures necessary to facilitate that (and the judge agreed), and I think they know that there is no way the family is going to find any where to take her. Everyone is still right where they are now until the 7th.

The agreement says that the family can provide a team to do whatever they want to facilitate transfer. It specifically mentions transferring the endotracheal tube to their own ventilator and take all the leads that are attached.

We all understand that this family is deluding itself. They just don't know it.
 
But I don't think that includes performing surgery to insert the trach/feeding tube. I read either on the All Nurses site or the blog referenced there that she would be manually ventillated during transfer. ???

The agreement only says they arent taking the hospitals vent. Almost goes without saying. They don't fit but I have never worked on an ambulance that didn't have a vent. That isn't to say every service carries them. If a vent malfunctions then yes you have to manually do it.
I would not go near this transport with a ten foot pole. Not just because of the family but because of all the unknown legal questions surrounding it. What if she codes during transport. What are you supposed to do ? My inclination is not a thing. Proceed to nearest ER for a calling. But how does a doctor call someone who already has a death certificate? How is the mother going to react when nothing is done. Not well I presume.

It says they may take the tubing and hook it up their own vent. I would presume that to mean the transport company.
 
I would find this case fascinating were it not so tragic. I have been to the nursing site as well as here and there is so much good information that I wish everyone would read it and be informed about certain medical terms. It could help everyone understand if heaven forbid anything were to happen in their families.

I do want to give a BIG thanks to all the nurses out there and on this thread.:love::love::love:! You are the heart and soul of every hospital and medical facility!

My DS had bone graft surgery for his cleft palette in September and it was scary, but they (and the whole medical staff) were awesome. Years ago when I had surgery, I was stuck in post-op waiting for a room and was unable to call my 18 month old before she went to bed. I was so upset but a nurse lent me her cell phone so I could call:hug:.

I don't really have time to read back thru the thread, but has it been stated about the possible cause of her code?

She was so young to have multiple health problems. Surely it was stated she was risky surgical candidate.

Only rumors and innuendo. The court redacted that info from the public record.

And as a research facility, it could also perform the procedures the family wants done without all the legal and ethical.

After the huge ordeal the hospital made? They are delusional! They went to the media. Thanks for the update - I had just checked our local news websites and they just said that the hospital would release her to the coroner and the family would then sign off on some papers with the coroner to get her and transfer her where they are taking her. However that article said the family was keeping that place a secret and wanted their privacy. Interesting that just a few hours later they've released the name of it.
 
As much as I hate to say it, I'm beginning to think the parents actions are for the wrong reason. Yes, perhaps it has started out as grief but now maybe they are looking to profit off it and not just by suing the hospital.

It's a terribly sad situation all around.

I think they are so overcome with grief that's it's turning into blind anger.
I wonder if fighting over her was a way to not deal with the reality of the situation. Now they don't have that fight anymore they are coming up with new one to distract them from reality.

I can see this with the mother. There are people around her though that make it seem pretty clear they know what they are doing...

I totally get why they might file a malpractice suit...heck, there may even be malpractice.

But, these are the people who contacted the media, who've done interview after interview, who've dragged CHO through the mud while REFUSING to let them tell their side of the story and NOW they complain about invasion of privacy.

I hope the court drop kicks this lawsuit into the nearest garbage bin. It really, really, really makes me question their motives.

Yeah, it's pretty ridiculous that they are trying to sue the hospital for violating their privacy. The family is the one who went running to various media sources and saying all kinds of stuff. And not to mention that the details of the stories did change many times. Heck, they even allowed the UKs DailyMail interview them several times! Here's one of the articles
