Around 4 pm, I got a call from M, the property mgr for our subdivision. She's looking for DH who isn't home from work yet. I ask her to call R (the vice pres and next door neighbor) and give her his number. She calls back saying he isn't home. I ask her what's up and she said she got a call from another homeowner complaining about people in the pool. Which, as I stated a week or two ago, ISN"T OPEN YET! I asked her what she wanted ME to do about it and she suggested I call the police. Which I did.

There isn't a chain and padlock on the gate right now because some schmuck keeps taking it off. We aren't sure if it's the pool guys or the landscaping guys or what. It could be somebody just taking a pair of bolt cutters and cutting it off for all we know.

The pool isn't clean yet. It won't be cleaned until I think sometime this week. It's not supposed to open until Memorial Day and the code hasn't been given out yet. So we know that whoever is in there is breaking and entering. Dh had to kick people out yesterday which really peeved him off. :furious:

I mean, I know it's warm enough out now to use the pool BUT IT ISN"T OPEN YET PEOPLE! There is a REASON you don't have the code and it's not because we are ZOMG mean people. It's because it's currently UNSAFE you brickheaded maroons.

He's had to kick several groups of people out of the pool in the last two weeks and it's really starting to annoy him. I'm glad Memorial Day is right around the corner and the pool will be open so that people can stop complaining that it's not open yet. :rolleyes1

How frustrating for all involved. Sounds like some communication is in order with the users of the pool...

Just a thought, but a pool is considered an attractive nuisance and you have to be REALLY careful about keeping it secured. Go get another lock so that it can stay locked at all times. Very scary the liability there! I would hate for it to go from frustrating to tragic.

DH has replaced the locks 3-4 times in the last 2 mos and he's sick of replacing them. Mostly because he's had a hard time getting the mgmt company to reimburse him for the chains/locks.

I would hate for it to go from frustrating to tragic.

Me too, but the mgmt company doesn't seem to give a flip. We've had a lot of problems with the pool since it was installed five or six years ago. Half the time the gate is chained shut because the pool guy didn't clean it properly or there is a leak or something. Honestly, I wish they'd fill it in with dirt and turn it into something else..a basketball court or whatever. But then people would probably complain about the noise from that too...:faint:

I think I remember from a previous post you had that you've been advising your DH to call the police but he doesn't want it to come to that (or something along those lines). Well I'm sorry but after reading this thread your DH is going to HAVE to put his foot down and call the police. What is he afraid of? Hurting their feelings? They are taking advantage of his niceness ('niceness' being lack of administering harsher consequences) and walking all over him.

People can't take advantage of you unless you let them, and your husband is letting them. He should've called the police a long time ago to show these morons he means business and this is serious.

First...what is "ZOMG"?

People are actually swimming in that ewwwwwwwwwwwwwater?!? Gross!!! :rolleyes2

I'm with Snow Brite. Something bad could happen if unauthorized trespassers aren't stopped.
Some kind of emergency action needs to be taken. Is your DH the president of the association? He should be able to call some kind of emergency meeting of the executive board/board of trustees so everyone can agree on what should be done.
Prior to that, maybe he could put TWO padlocks & chains on the gate that ONLY he has keys/combinations to. All prep work would have to be halted unless a board member or their representative or the property manager were present. Get the gate alarmed. Have a talk with the local police station that people are trespassing into the pool area, so they can keep an eye on it.

Good luck, let us know what happens.
agnes!

ETA: Just read the other posts. If he is getting frustrated with his post(being the leader of a volunteer group is often not a lot of fun!), maybe he should think about resigning, especially if the management company is being continuosly difficult to work with.
Of course...couldn't the management company itself be fired?

I know and I've told him that but he doesn't listen to me. It's a good thing I couldn't (and really didn't want to) go down there myself. There would've been heck to pay.

Better to let the police deal with it. Afterwards, there are no dead bodies to hide. ;) :teeth:

*eta--ZOMG is an internet phrase I picked up on a message board. It's like OMG, but worse. :teeth: **

Ok here goes a probably dumb question, why isn't it clean?
I live in California and mine is clean all year. I know things freeze back east but I am assuming as soon as things thaw back there we would have our pool clean swimming weather or not. It would just gross me out to have a dirty pool.

It's not clean because the mgmt company doesn't pay to have it cleaned once the pool has been 'closed for the season' (usually around Labor Day or thereabouts).

Now I realize that this is Texas and that 'swimming weather' starts somewhere in mid-April and usually lasts until mid to late Sept. However, the mgmt company (which can be cheap as all get out on some things) doesn't see it that way. They only contract the pool cleaner from Memorial Day to Labor Day and why that is I don't know.

The mgmt company has done this HOA and the homeowners wrong ever since they were hired. We are currently trying to rid ourselves of them and the HOA altogether, since none of the homeowners really seem to want either one. If we get rid of the mgmt company and the HOA, the pool becomes public property, which means it would be the town's problem, not ours.
