What is my coworker thinking?

Ok so we are all getting laid off in March of next year, so they have approved casual dress until the end. Well one of my coworkers REALLY pushes the casual dress. Anyway today he came in wearing some ratty jeans and a t-shirt that says "I Have Nothing Nice to Say" in nasty lettering.

Here's the kicker....HE HAS A MEETING TODAY WITH HR, SUPERVISOR, AND MANAGER. We are all sure he is going to be fired, but either way, why the hell would you wear a shirt like that to work EVER??

Then again, it's not a huge surprise he is having this meeting...

maybe he wants to get fired.

Possibly, but it's not like he has a case for wrongful termination, I mean there is no way his unemployment would be approved!

This is why I put my staff into uniforms. Some people just don't have any sense.

i'm thinking the same thing too-and maybe he's figured out some kind of short term financial advantage to being fired vs. waiting for lay-offs.

it was stupid (in my opinion) but i had co-workers do this. they knew if they quit or got layed off they could'nt draw their portion of retirement contributions out of the system (and did'nt have enough time in to dream of ever drawing anything worthwhile decades down the road) so they would pull some stupid small stunt to get canned so that they could get that $$$ and that they knew unemployment would still end up letting them draw under. summer was fairly popular to do this esp. if they were eyeing returning to college in the fall.

if the new dress code just came out and layoffs have already been announced it might be that he figures why not leave now and then just claim to edd that it was an unjustified firing (allot of employers have realy strict rules about what 'casual' is and is not for this very reason).

He's thinking that he's oh-so-cool, a very unique individual and quite the rebel. His wild T-shirt is making a statement and will show them!

depends-unless a dress code forbids it or a safety issue (like torn jeans in a work space with machinery it could get caught in) if the employer just allows people to dress "casualy" without defining what that includes/excludes unemployment may well approve the claim.

If they were having the meeting to fire him and you all think he's being fired wouldn't he have a clue himself? Maybe he just figures who cares what I wear if they are going to give me the boot. Granted thats something I would have done, when I was 16 but hey you know some people they never mature past their teens ;)

Just because the company is going belly up, that is no excuse for this type of complete lack of professionalism and respect for his job! I had an employee come to work wearing a tight white tank top, a see thru hippy skirt, skimpy white thong and bra underneath, which was very visible and dollar store shower shoes. We are medical social workers in a hospital!!! no one took anything she said or did that day seriously. You can be sure that the very next day we had a department staff meeting and a hard copy of the hospital dress code was provided along with pictures of acceptable dress for all potential occasions to include holidays, etc. We all then had to sign form acknowleding said policy. Once that was done, no more Grateful dead concert wear at work. The employee in question turned out to be a wonderful social worker and I worked with her for two good years. As she was leaving I told her how I had misjudged her when she had first started with us, all because of her shower shoes. Her reply stunned me, she told me that no one in her immediate are was taking her seriously and everyone was calling her sweetie and dear, etc and she was tired of having her ****s talked to. She told since she was being treated like a brainless dimwit and was making a point. I asked her if it worked and she said yes! I told her that was a quite a gamble as I voted to can her like a tuna!! when I was asked what we should do about it!

Oh he's not getting fired for that, it's just something that has bugged me because they always seemed to let him "stretch" the dress code standards.

We just found out he was fired and we assume it's because of poor job performance and attendance occurences. If you get X number of occurences, you get terminated.

If he knows he's getting fired today, maybe he just figured, well what the heck, and is showing is true feelings. If I hated my job and superiors that much, I might do the same thing.

I wonder what age/family situation this guy is in. Maybe the pending lay off has pushed him to the edge. Did his work habits change or has he always been this way. Some men feel under a great amount of pressure to be the provider, etc. and when a job loss is looming they feel like a failure.....esecially in today's job market and down economy. Lets face it, if you are the insurance carrier for your family......drawing unemployment doesn't pay much......if you have to pay insurance out of that it doesn't leave much for all the other things you need, food, utilities, etc.

If he's always been this way (job performance and attendance) I think he's probably just saying......"who cares".

I need to see her in my office right away;)

That day you would have needed to take a number after her stroll thru the hospital to the cafeteria for lunch. The receptionist noticed alot of random hospital staff coming up to our ward to say hello and meet new staff. Regardless, most of these new visitors were male. Actually no one said anything to her due to potential sexual harassment issue and potential discrimination issues ( yes, tall, leggy, gorgeous blondes do get discriminated against!!!). The staff meeting the next day basically took care of it, and ensured that no one would try that crap again!!

Yeah, me too. If I was a single guy with no dependants especially.

The problem, as I have experienced it, is that companies often make no attempt at defining 'casual' attire.

I'm curious as to how employers get it so unemployment is denied to former employees. We've had people steal from the company and they still received unemployment! We easily proved the theft and we were told by the unemployment office that we could take the former employee to court and sue for damages but they were still getting their unemployment money :confused3

I am a HR Mgr and handles many unemployment claims in 7 states. For theft, that would have to be the reason for the term. For instance, I fired someone for attendance issues and later found out he was stealing. I couldn't use that proof for unemployment since it was found later.

If the initial ruling goes against you; then you can appeal and present your case again. Usually the intial determination is done by phone and isn't as detailed as an appeal.

An employee has to do something that they either know is against company policy, preferably have been warned prior about or is so blatant that the employee should have know it would lead to termination.

Unfortunately unemployment depends on the hearing officer. Most look for ways to award unemployment if at all possible. I just lost an appeal where we warned the employee if they continued to leave early (for a 2nd job he recently got) that he would be termed. We followed all the steps in our disciplinary policy and he confirmed to unemployment what we said. He still got unemployment.:confused3

Perhaps that's because they make the mistake of assuming that professional adults would know that business casual does not mean miniskirts, see through tops, ripped jeans or t-shirts with lewd commentary on them.

Shame on a company for expecting professional adults to have common sense.
