What happens if you don't pay your annual dues?

Hopefully DH and I will be buying a resale at OKW Soon.

I'm thinking very far down the road if DH and I die (is there really any nice way of putting that? ) before 2042 (the end of the contract) and the membership goes to our children in our will. What if they're not interested in it and just kinda leave it sitting there not bothering to figure out how it works.* I mean we're so far from Disney World it's not like there'll be an expert nearby to explain it to them. We will hopefully leave instructions and details with our solicitor. But if they just abandon it and do nothing, i.e. don't pay the dues, will the contract just expire or will they be in some kind of legal trouble? I'd hate to leave that kind of legacy. Obviously if they don't pay the dues they can't use the points, but I want to be sure they won't be in any legal repurcussions for them.

*Another scenario is, that if DH and I both pass on (or the remaining one i.e. ME passes on ) a few months/weeks before the dues are due, perhaps even if they ARE interested in the contract they wouldn't yet have got around to sussing it out. What if they miss the dues deadline for a few months?? Can they catch up?

Your account gets frozen, your reservations canceled and Disney has the right to foreclose and take the contract back. Depending on the situation, I would guess that they would try to work things out with you if you were a little late.

It's simple, explain to your kids that monthly/annual dues must be paid or they may lose the contract. If they're not interested in keeping the contract, they can either give it to me or sell it through a broker. Be sure and leave the DVC phone number in a designated location for them to use in the event you should pass away before the contract expires. I'm sure DVC will guide them through whatever path they choose to take.

Here in the U.S., you can set up a monthly draft on a checking account, for dues payment. Not certain if that can be done on out-of-country accounts. I think Disney would have to wait at least several months before going through foreclosing the account, and that would give some time for the heirs to catch up on any back dues, if necessary.

In any case, since you are buying resale, you are obviously aware that these contracts can be sold, in the event your children are not interested in continuing to enjoy Disney vacations. Why not leave information regarding the company you are purchasing through with the membership records you keep? That way your children would know who to contact, should they wish to sell.
