Virtual Notary - can you insist ?

I saw the option on my contract (board sponsor) that I could opt in for online notary for a fee.

Can you insist both parties do this? And do they charge both parties?

I don't mind the $150 plus fee since I got my price but I feel like this only makes sense if both can do it and it saves the " been waiting for 2 weeks for the seller/buyer to go to the notary " issue.

I am aware international can't do this. But for the domestic purchases it seems a no brainer and the cost could be split?
 
I’m sure you could ask for the other part to use a virtual notary, although that would be an unusual request. I’m not sure if the agent would pass this along to the other party. You can’t insist upon them using one.

You can no insist that the other party does anything. You have absolutely no control of the other party unless it is in the contract….
 

You can’t dictate the sellers moves and as someone who has sold quite a few, I’d not have accepted any deal like that.

But, it couldn’t hurt to ask.

Do some resale brokers provide the online notary for free? ( I thought I read that somewhere ). I recently sold with the board sponsor and asked if they would waive the online notary fee ( they never responded to my request - which I guess was the response ... hehe 'no' )

FWIW, if you don't want to round up witnesses.... banks typically notarize for free, I've never been able to get them to provide a witness... one bank teller suggested I ask other people standing in line to witness ( less than ideal, but found people were willing ). Libraries may do for free or cheap. I've found some license bureaus notarize for cheap - we have one locally that has no problem providing witnesses - and only charged $5 for all notarizations...(4 signatures for seller? ... don't recall off the cuff)

When I bought my latest resale contract the online notary was just part of the process, there was no option to use my own notary that I could recall. I'm sure I could have asked for one if I wanted to, but I prefer an all-online process whenever possible.

As discussed DVC has been using online notaries for direct purchases for quite a while.
 
I sold a contract recently via the board sponsor and between the virtual notary fee and the wire fee they wanted to charge me it was almost $200. Considering this was a fairly small contract that was a pretty big chunk of the overall price (not to mention their hefty commission). I opted to do it the old fashioned way in person (and had them mail me a check) all for free as my local bank can do notary sessions.

Thats what I am finding , they are already the most expensive title company and the add on fees are pretty high. But the contract sold in 7 minutes ( literally sold before my agent gave me the confirmation that it was listed) and I got $5 more a point than I paid for it 4 years ago. So I guess they can get away with it.

The cost and time saving hack when buying or selling with the board sponsor is to use DVC Title & Escrow as the title company. The closing fees are lower and online notaries are $40 vs $150 plus closings are typically faster given the simplicity of the doc packages. If you are the buyer, you can always offer to pay a slightly higher price to cover the cost of the sellers online notary. The seller may or may not follow through, but it's always worth a shot to promote the idea of them electing to do a remote online notary session.
 
Magic Title does not offer a virtual notary for domestic or international. When I spoke to the manager she said that they tried to get approval for that and it was denied. I dont know why they would be "denied" when other Florida title companies are doing it. For whatever reason, Magic doesnt want to offer that.

Mason offers free virtual notary and their own witnesses so you dont have to find people. Its so fast and easy i was floored after doing Magic's archaic process.

You can't tell the sellers how to notarize. I asked my agent at board sponsor to please ask if the sellers would consider virtual notary or even i would pay for their notary. She said she would nudge them in that direction and i don't know if she ever did, but it never happened
