SUCKS BIG TIME...

Our vehicle was rear ended in August. It was totalled. The police even witnessed it. Black and white no dispute claim. Not our fault. What should have taken a maximum 10 days to settle (according to them):rolleyes1 has now drug on 3 months with no settlement cheque. We even had the special insurance that replaced the full cost of a new vehicle.

This is what happens when you outsource to a complete bunch of incompetent idiots, especially to our lovely adjuster FB whos name I wont mention for being the most incompetent of all.:headache:

You're right, that totally sucks! Same thing happened to my hubby back in March, our car was an '06 Toyota corolla, but it was ours and paid off! We had to total it, and only got about 7k for it. We had a few days to find a replacement, but in order to not have a loan, we had to put in approx 4k of our homes's equity we where saving for our basement Reno....now we are about 3k on our line of credit for the final holdback on our basement Reno....oh well, if that hadn't happened, our basement Reno would have been paid in full, it wasn't worth it to have a small loan though, as they wanted to charge us exorbitant interest to borrow a couple grand. We managed to find a 2009 Honda fit with only 10,000 km on it, but we couldn't talk the dealer down any more so ended up dipping into our savings to avoid another car loan!

The Toyota was going to be our sons car, but now that we got the fit, those plans where squashed, as the fit is a standard and he hates it/ doesn't want to learn stick shift! Oh how a accident can turn your life upside down! Thankfully our ins company was pretty decent (AXA) and things went fairly smoothly....settlement took less than a month for us! I hope they get their act together for you :eek: three months and hanging is crazy!
 
I would step it up a bit and take your complaint to the manager of the claims department.
If that doesn't work go to the ombud of the company.

We did that a month ago. Went over her head directly to the manager. The manager was told on November 9th she had until Monday to cut the cheque or we were hiring a lawyer. On November 10th the cheque was cut and mailed. Guess what...? they sent the cheque regular mail and now it is "lost" in the system. They will put a stop payment and re-issue us a new cheque Monday morning to be sent by courier if we dont receive it.:upsidedow

Does Canada allow you to sue the other driver directly if the settlement offer does not satisfy you ...

Is the 7K retail value? It should be.

Not sure about Alberta, but in Ontario, it's "no fault" insurance, so you cannot directly sue the other driver.

You CAN sue the insurance company... that would help you to get back your equity, no?
 
We can sue their insurance company. Update: Cheque was mailed November 10 and apparently "lost":rolleyes: Had the cheque stopped and re-issued November 25th. It was mailed last week or so they say. We will see:laughing:
 
My complete sympathies with you having to deal with TD insurance. My father had them for his mortgage insurance, and he passed away a year ago November 14th. We are still battling trying to get the money from them, have had to hire a lawyer, pay numerous specialists to write lettings saying that the reason they are denying it is bogus, and threaten to sue twice (the suit was already filed as we only had a year from the date to file it, they have not yet been served because we are hoping and praying it works this time).
