Vent- florida traffic court

I guess evidence counts for nothing in florida traffic court. Here is the scenerio i.e.. my rant and boy am I pissed. My wife was pulled over going 46 in a 30. She had just pulled out of her work parking lot. We go to court today and here is what happened.

Firstly the cop states it is a commercial area with high business and the traffic is moderate at lunch hour. He states that he caught her speeding going around a curve and then passed the road where my wife comes out of. Upon questioning he stated he was about 250 feet from this road. I brought pictures showing the building my wife works and the road she comes out of(the road the cop had her passing). When asked how she could have hit 46 mph in about 2 feet he starts to stutter. I then showed with a mathematical formula that a car going from 0-46mph in a 2004 chevy aveo would travel 932 feet before it reaches that speed. However, the cop already admitted that he was 250 feet away and could not answer how she was speeding 46 mph when she pulled out(5 speed stick aveo at that). The judge turns around and states the officer is certified and his gun was working properly so she is guilty. ***. It does not matter what evidence you bring to court here you are already guilty the moment you walked through the door.

On another note. Another guy was pulled over for passing a school bus. The guy states wait a minute it is 5 pm and there was no bus there. school let out nearly 3 hours earlier. He then states the cop told him he looked like he could afford a ticket which I believe. The verdict: guilty. Every single person was guilty. When I left people were shaking their heads. Now to appeal it will cost me much more in fees to appeal the ticket than the actual ticket fine but they can kiss my *** cause I am going to court. I hate scams.
 
That is the way it is in one area of Virginia. If you go to that court, it does not matter WHY you were speeding. The judge simply stated that he was not here to listen to why they were speeding. Were they speeding or not? The law states a speed limit and if you go over it, you are guilty. I did however get a chuckle from some of the excuses people had for speeding.

Unfortunate that no matter how much evidence one might have to prove innocence, as long as the person with the badge says otherwise, you are guilty.
 
I've never gone to court to contest a ticket. From what I hear, pretty much the only way you can ever win is if the cop doesn't show up.
 
Amen to that. The police officer was obviously caught and the judge knew it and did not care. I was the only person to walk in with pictures and the officer verified everything we said. you simply cannot speed up to 46 mph before you even pull out on the road and even had she turned onto the road it would have taken her 932 feet to reach 46 mph and the cop was only 250 feet away- by his own admission.
 

wow... what a jerky judge... my mom has an aveo. i've driven it. it's like a rollerskate. i don't even think you could get to 46mph in 1000 ft unless you floored that thing. and then it'd probably fall apart from the stress.

I went to traffic court for an accident I witnessed (they were trying to determine who was at fault).

The case before ours, the lawyer (who brings a lawyer for a speeding ticket? :confused3 ) asked to see the maintenance records for the radar gun. Since the cop didn't bring them, the ticket was cancelled and the case dismissed.

I would contest it on principle--and then bring more evidence. I wish I could remember what my physics teacher utilized...but I think since he had a degree in the subject, it worked to his advantage and credibility. (he used formulas and stuff).

It made for a REALLY cool physics lesson. (And not on how to get OUT of a ticket--but how he could prove that his girlfriend was accused and ticketed for something that was mathematically impossible).
 
My guess is that you "saying" that is that is the road your wife comes out of, does not make it a fact or evidence.

Not saying your story is not true, but according to your math it is possible.

It just seeemed odd to all of us to hire someone to come in for 10 minutes and ask "May I see the maintenance records on the radar gun?"

I'd be willing to bet that this guy was on retainer for other things as well and the accused probably may have gotten ticketed a few times before or something. This was 15 years ago so :confused3 .
 
It's pretty difficult to get a speeding ticket completely dropped when the officer uses a radar gun. As a previous poster mentioned, asking for the maintenance/test records is one way to show that the gun was having problems. They have to check the guns regularly.

It sounds like your math assumes that your wife was going 0 mph after making the turn, when most folks would already be going 20 mph or so, afterall you have to have the car in drive to make the turn.

I did actually bring a physics/math equation.
distance=(1/2) * acceleration * time^2

he stated the acceleration was 46 mph. I had proof that an aveo takes 6.4 seconds to reach the speed of 45 mph. With that formula as a pro racing driver she would have had to travel 932 to reach the speed the officer stated. He stated he was 250 feet from the part of the road she was clocked out making it a mathematical impossibility. I could hear some people snickering in the background. We also proved she worked at that building which is not hard to do. It was also lunchtime and the road was crowded. The judge did not care as long as the radar gun was working. How about yeah it was working but you got the wrong person. Oh no that would be the court loses out on $250 which, incidentally, pays the judge's salary.

Nope. I worked part-time for an attorney who traffic law as one of his specialities (he was also a reserve deputy on the weekends :rotfl: but I digress). People who have had past points due to tickets fight so they don't get additional points and have increased insurance rates or so they don't lose their license.

As for the judge and traffic court in general...if the radar gun was properly maintained the ticket is going to stick not matter what formulas you throw out there. I also wonder how you acted in court. popcorn::

I got rear ended last week and it took FHP an hour to show up to the scene. I told the trooper I had lost my wallet but had paid for a new DL that the state was mailing to me. he ran my insurance, plate, and registration and still wrote me a $76.00 ticket for not presenting a DL upon request,even though I had explained my situation.

so I get to take off work next week and present my new DL the state had mailed me and pay the court costs to get the ticket removed. :upsidedow

he sure was. :) you're married to one, aren't you?

:scared1: Heck, no, I know a former trooper though. He's actually now an officer in DH's agency. He still misses the hat. So yes, DH is in law enforcement, but he is not a trooper. :) Seriosly, troopers are a whole other breed. :upsidedow

dealing with him was like a full cavity search with a fist. and I was the one that was rear ended. (by the van behind me, not the trooper)

OT, but I'd be ticked too if I had to go to traffic court in Florida all the way from Akron, OH.
