Unemployment question

I'm going through the steps of unemployment, and I got a piece of paper in the mail that said I was going to be getting a call from an agent on a certain day. I got the call, the agent asked me a bunch of questions, then said that he had to call my former employer and put us on a 3 way. He said that this is how it works. So the agent put me on hold, and called - He was told that the person he needed to speak with was out for the day. So he told me that they had till 3pm the next business day (today) to get back to him, and then he would call me, and do the 3 way.

So my question is, its after 3pm the next business day, and I haven't received a call - What happens now?

When I spoke with the agent on Friday, I asked if they were disputing my unemployment claim, and he said no.

I've never had a 3 way, I guess it varies from state to state. I know they spoke to the HR dept and told me the results. If it's not being disputed you should be good to go.

When I was applying they did the same thing, but when the person was not available, he said he would contact them without me. I wouldn't worry wait another day and check in with unemployment.

I handle unemployment claims in 7 states. The deadline is given to a company and if they don't respond then the examiner makes the decision based on the facts they have.

This does not mean that automatically you will receive unemployment. I had a former employee recently who did not receive unemployment despite the fact that we didn't dispute it. Former employee said something during interview that got him denied.

It always varies state to state. I just went through the process in MD. Here, the day a person files their initial claim, the employer is sent a form to fill out and return within 8 days. If they do not do that within 8 days, benefits are automatically paid (assuming the claimant has met all the other requirements). A friend of mine in Minnesota said they have 30 days there.

Perhaps your benefits will automatically kick in now. I wouldn't worry too much if they have already told you your benefits aren't being disputed.

Thanks - So should I be expecting another call from the examiner, or thats it at this point?
And just our of curiosity - What type of questions would have been asked durring the 3 way?

You should receive an decision in the mail. If you lose there are instructions on how to appeal. The company may be able to appeal if you win.

Questions usually focus on a "final incident" and if you knew it was wrong but did it anyway and if you were informed at any point that whatever you did may result in termination (usually either a handbook or written warning is offered as proof if they exist).

The examiner asks questions of each side and the answers may lead to more questions.

If you were termed for poor performance, in most states, that allows you to collect unless the company can show you were deliberately not doing your job.
