So here I am in the BUDGET forum because I'm on a BUDGET trying to save money. I just posted last night in another thread about how tight things are -- kids need braces -- car need repairs -- & after some encouraging words from others I went to bed feeling good about our finances & sure we'd get to Disney again some day.

Today my husband comes home from work -- he spent the day actually NOT working but working on a Habitat for Humanity house -- something his employer is big on. And he's coming home from the house -- and gets rear ended!! AND the guy who hit him doesn't have insurance! My husband said he was driving a brand new Yukon. And no insurance. AND his stereo was blaring & he thinks he was either talking on his phone, or texting. And the cop just shook his head -- nothing he can do.

ARGH!!!! I just started to cry. My car -- the only car I'd ever bought BRAND NEW -- was totaled a few years ago by a 16 yr old girl who rammed into me because she was busy changing her radio station. We do NOT have luck with cars

Sigh --- I would buy a horse, but he'd probably die :(

Sorry to hear that! Don't you have uninsured/underinsured coverage on your own insurance? You can also sue the other driver for damages. Not what you want to have to deal with (I'm sure!) but at least the weight of this shouldn't be totally on your shoulders (financially!)
 
I'm so sorry!! Check to see if you have uninsured driver's coverage. My car got hit by a large box last week, dented the hood and completely shattered my windshield. Luckily, the guy actually stopped and had insurance. I hope your insurance covers it! --Katie
 

:grouphug: Sending you hugs!! You know, it seems like "when it rains, it pours". We had that kind of year last year and I felt like we were NEVER going to recover. But we did... you always do. Somehow, we're stronger than we think we are. I hope things get better for you soon. :grouphug:
 
Not sure how things work were you are, but my sds was hit by an unisured driver here in Colorado in Feb, in March he recieved a letter from Victims compenastion asking for all the bills to repair his car. We didn't send it back in as Dh was able to fix the damage himself for a couple hundred dollars.
 
I empathize. My dh was rear-ended by a girl in a brand new truck. It was her boyfriend's vehicle and she was not covered. We have uninsured motorist on our policy but we were still responsible for the $500 deductible.
The police didn't even ticket the girl for having no insurance.
 
Most lien holders require a person to have insurance on a vehicle before it leaves the dealership or they have something called "Forced Insurance". I don't know where you are from but in NM you can't leave the dealership lot without insurance and can't register your car without a current policy. If it is discovered by the lien holder you have cancelled your policy they basically add it on to the loan.

I'm sorry :grouphug: that you are dealing with this. I would have your insurance company go after him. Thankfully, it sounds like your DH is ok.
 
Been there. A high school student hit me, and at first took off, but then she turned around. I guess her conscience got the better of her, and she came back. She was crying and begging me not to call the police, but I told her I had to, and I already memorized her plate # so she needs to stick around. While we were waiting on them, she called her mom, and her mom showed up very quickly and was telling her in spanish that she needs to leave. I am white, but speak very good spanish, and I told her mom right back in spanish that I memorized her plate #. Her mom then just left. When the police got there, the girl had no insurance, no license, and both stickers expired. What did she get? A ticket for truancy, because she was supposed to be in school at that time. My uninsured motorist insurance covered the damage, but it was the same, I had a $500 deductible. Besides that, for the longest time I would receive prank calls in spanish, and I think it was that dumb girl's mom.
 
I feel your pain. I was hit by a 21 yr old girl at the end of March whose insurance ran out five days prior. What I've learned is that no matter if the other person has insurance or not, the innocent party is always the loser. I ended up in the er and went to PT for months for whiplash and she totalled my minivan to boot. Our uninsured motorists only gave us $8,000 for the van so we had to take out a loan to buy a new vehicle. I still haven't settled my bodily injury claim but it's not like I'll get that much and out of that I have to reimburse my health insurance for any claims they paid. It's not worth suing her since she's a student who lives at home and doesn't have any money. The lawyer I consulted even said it wasn't worth it.

I hope you at least get something but I know it's like starting over. Maybe since the driver had a brand new vehicle he also has money if you do have to sue. Since my insurance co is paying everything through my uninsured motorists, once I settle everything with them I assign my rights over to them so they can go after the girl for reimbursement. It might take longer than you'd hoped but keep your Disney dream alive.
 
That is just a crock...for all of you! Sending happy thoughts everyone's way. I am not a litigious person, but if he is toolin around in a new truck, I would start researching the least expensive way to go after him.
 
We do have uninsured insurance -- but I'm afraid they are going to total out his car & let me tell you, it's not worth much :( I am in Wisconsin, I have no idea what the laws are about being insured -- because I've always been insured! We won't know anything until our ins. company sends an adjuster. He JUST got new tires on that car too :(

My MIL called tonight & I told her the story - she also suggested suing. She & my FIL did that years ago & they got 3x more than what the ins company was going to give them. Not what we want to do but if he's driving a brand new vehicle he must have $$$ - insurance or no insurance. I'll keep you posted!

I am so sorry to hear that. I hate stupid people! As others have said, though, call your insurance company. They will cover the damage and sue the other driver for whatever they can. Good luck!
 
I'm sorry. I hope things work out well. I can relate a bit except I was in the brand new car (okay it's a year old but in great shape). Some guy just hit the gas and rear ended me while we were both at the light that was still red. After he produced an expired insurance card, we called the police. He has coverage but they are being buggers about some things.

If they don't total the car, make sure to look in to him paying loss of value on your car.

If they want to total the car make sure the insurance company takes the value of the new tires into consideration and any other aftermarket parts.
 
I'm sorry about the accident.

Just because he has a new car doesn't mean he has any money. I am sure it is financed. Other Dis'er stated that a financed vehicle must have insurance, which is true. However, if can and will be cancelled if you don't pay your monthly premium which is I'm sure what happened.

And, the same Dis'er mentioned the finance company adding insurance should the driver's insurance be covered, which is also true, but I beleive it only covers the interest the finance company has in the vehicle which struck you.

(I know this because there was once again a mix-up with my finance company telling me my insurance had cancelled. NOT! Anywho, they sent me a letter telling me they would insure me if I didn't provide proof immediately. The insurance they offered was about $40 a month cheaper than what I was paying so I called them and wanted their insurance, but it only covered THEM in case I totalled the vehicle ie: i wouldn't see any money, it only protected their interest in the car)
 
Just an FYI about the tires, I had a car totaled once too the same day I had it painted, new tires put on and some other work done. Anyway, while we were waiting for the adjuster we swapped the tires with some old ones and my dad was able to use the new ones I just bought. I didn't want to see 4 new tires go to the junk yard for someone else to salvage and use!
